Reporting to the Chief Diversity Officer (CDO), the Deputy Director of Investigations will assist in implementing the CUNY equal employment opportunity (EEO), Title IX, Enough is Enough, and diversity policies at the Borough of Manhattan Community College by ensuring compliance with relevant federal, state, and local statutes. The Deputy Director of Investigations works closely across the college community to foster a safe and supportive environment for all students, staff, faculty, and visitors.
The Deputy Director of Investigations is responsible for:
-Conducting the intake and investigations for EEO and Title IX/Enough is Enough complaints resulting from reported allegations. Engaging in the investigation and resolution of complaints asserted under Title VI, VII, IX, Section 504, federal/state/local non-discrimination laws, the ADA, CUNY Policy, and under any other law that prohibits discrimination based on a protected status.
-Using investigation protocols to plan each investigation, conduct interviews, collect relevant information, and document and issue findings.
-Advising the Reporting Party, Accused Party, or others as appropriate on the reporting process, case disposition, and about support resources available at the college and in the community.
-Evaluating complaints and referring those which are not appropriate for investigation to other units.
-Collaborating with campus stakeholders (Student Affairs, Legal, Academic Affairs, Human Resources, and Public Safety) on investigations and trainings.
-Maintaining and monitoring data related to the status and outcome of complaints and investigations.
-Evaluating investigative practices and recommending improvements; Assisting in preparing periodic and annual reports on investigations and related metrics.
-Implementing trainings, both in-person and virtual, covering relevant local, state, and federal laws, CUNY and campus policies and procedures, and approaches to preventing and responding to reports of sex-based harassment.
Under the supervision of the CDO, the Deputy Director of Diversity and Title IX Compliance will also:
- Assist with the preparation of affirmative action plans.
- Develop training to faculty, staff, and students regarding EEO laws and policies, sexual harassment laws and policies, accommodations policies, affirmative action, and related best practices.
- Partnering with search committees and other personnel involved in the search process to ensure good faith efforts are made to recruit diverse applicant pools.
- Performing related duties at the request of the CDO to advance the mission of the Office of Compliance and Diversity.
QUALIFICATIONS
Bachelor's degree and eight years' related experience required.
Preferred Qualifications: J.D. or advanced degree or certification pertaining to investigations experience preferred. Eight years of progressively responsible experience in a legal, student conduct, student life, human resources, or similar field. Investigatory experience, excellent verbal written communication skills, as well as strong presentation, interpersonal skills, and an ability to work collaboratively with various campus representatives. Experience working on compliance with Title VI, VII, IX, Section 504, federal/state/local non-discrimination laws, the ADA, and regulatory requirements in a higher education environment will be considered highly valuable.
In addition, preferred candidate will have experience in the following:
Conducting complex investigations into allegations of unlawful discrimination and harassment.
Detailed understanding of non-discrimination laws, including Title VI, VII, IX, Section 504, Violence Against Women Act, the Clery Act, federal/state/local non-discrimination laws, federal/state/local disability laws, and related regulations
-Demonstrated understanding and sensitivity regarding experiences and expressions of trauma caused by sexual violence and harassment.
-Strong analytical, organizational, and communication skills (verbal and written).
-Willingness to work collaboratively with key constituent groups and community partners.
-Ability to perform in a time-sensitive environment and work independently. Strong interpersonal and listening skills.
-Demonstrated ability to adhere to privacy regulations and to maintain confidentiality as needed.
-Ability to thrive in a fast paced and deadline driven environment without sacrificing thoroughness and attention to detail.
CUNY TITLE OVERVIEW
Conducts comprehensive investigations of human resources concerns and complaints and assures issues are properly reported, answered and remediated.
- Conducts in-depth investigations and fact-finding interviews using appropriate action plans, investigation methods and interview techniques
- Writes investigative reports documenting methods, findings, evidence, conclusions and recommendations
- Manages a caseload of assigned investigations
- Develops, implements, and oversees multi-faceted training and related programs on effectively conducting and documenting investigations
- May conduct investigations in conjunction with a college or University-level office
- Performs related duties as assigned.

Salary range: $115,333.00 - $132,987, commensurate with education and experience.
