Summary The United States Attorney's Office for the Southern District of West Virginia prosecutes federal criminal offenses and defends the interests of the United States in civil cases. Duties The U.S. Attorney's Office for the Southern District of West Virginia is seeking two Assistant United States Attorneys (AUSAs) to serve in the Civil Division. Civil AUSAs represent the United States, its agencies, and its employees in federal court and are committed to justice, excellence, fairness, and service to the public. AUSAs handle all phases of civil litigation and investigations, including legal research, discovery, motion practice, settlement negotiations, trial, and appeal. Position 1: Assistant United States Attorney – Bankruptcy Litigation The attorney selected for this position will primarily litigate before federal bankruptcy courts in the district, representing federal agency creditors in Chapter 7, 11, 12, and 13 proceedings and adversary proceedings. Creditor agencies include the Internal Revenue Service, the Small Business Administration, and the Department of Education. The AUSA is assigned cases from inception to completion as the sole attorney representing those agencies, preserving their claims to payment from the bankruptcy estate. Duties include legal research, drafting legal memoranda, preparing and responding to discovery, taking and defending depositions, and representing the United States in judicial proceedings. The AUSA may also be assigned other civil defensive or affirmative cases as needs arise. Responsibilities increase and assignments become more complex as training and experience progress. Position 2: Assistant United States Attorney – General Civil Litigation The attorney selected for this position will handle a wide variety of civil matters, including defensive litigation such as personal injury, medical malpractice, employment discrimination, challenges to agency action, and constitutional claims against federal employees. The position also includes affirmative civil enforcement (healthcare fraud, procurement fraud, financial fraud, pharmaceutical diversion, violations of civil rights statutes) and defense of immigration cases, including detainee challenge and denial of benefits applications. Residency Requirements Assistant United States Attorneys generally must reside in the district to which they are appointed or within 25 miles thereof (see 28 U.S.C. 545). Selective Service Male applicants born after December 31, 1959, must certify registration with the Selective Service System or note exemption (see Security Requirements Initial appointment requires a satisfactory preemployment adjudication, including fingerprint, credit and tax checks, and drug testing. Continued employment is subject to a favorable background investigation. Conditions of Employment Must be a United States Citizen or National. Must be registered for Selective Service, if applicable. Applicants must possess a J.D. degree (or equivalent) and be an active member of the bar (any U.S. jurisdiction) by their entry on duty date. United States citizenship is required. Preferred Qualifications: Applicants must meet all qualification requirements upon the closing date of this announcement. Salary Information Assistant United States Attorney's pay is administratively determined based, in part, on the number of years of professional attorney experience. The range of basic pay is $65,563 to $171,487 plus locality pay where authorized. Relocation Expenses Relocation expenses will not be authorized. Travel Occasional travel may be expected for this position, both within and outside the district.
