The Group also provides legal consulting to Firm clients on information governance policy and practice across all phases of the litigation/investigation lifecycle. Responsibilities Correspond with clients and forensic vendors on data identification, preservation, and collection, including issuing and managing litigation hold notices and ensuring defensible preservation practices Draft, review, and negotiate ESI agreements, TAR/CAL/GenAI review protocols, protective orders, and e‑discovery stipulations Prepare meet‑and‑confer correspondence and participate in Rule 26(f) discovery planning conferences with opposing counsel on ESI scope, form of production, and preservation obligations Conduct legal research and draft memoranda on e‑discovery issues, including proportionality analysis under FRCP Rule 26(b)(1) and spoliation risk under FRCP Rule 37(e) Deploy and manage search terms, analytics, AI/TAR workflows, and technology‑assisted review validation, including statistical sampling and quality control measures Oversee document review teams, including developing review protocols, training reviewers, conducting quality assurance checks, and performing second‑level document analysis Manage e‑discovery vendor relationships, including evaluating capabilities, overseeing data processing and hosting, and reviewing invoices for accuracy and cost control Support information governance initiatives, including assisting clients with document retention policies, data mapping, and defensible disposition practices Billable hours expectation is 1,850 hours annually, with discretionary flexibility as the candidate grows into the role. E‑Data Attorneys are not expected to progress to Membership, though off‑track promotion opportunities are possible. The Firm will support required training, association dues, licensing, and continuing legal education (including relevant industry certifications). Collaboration is an important component of any role at Mintz; the Firm therefore requires working from the office 60% of the time (remote work is permissible 40%) in accordance with the Firm’s published guidelines. This position is available in any U.S. office, with Boston, Washington DC and New York preferred. Qualifications Juris Doctor (JD) or LLM from an ABA‑accredited law school Active bar admission in Massachusetts, New York, California, Florida, or Washington DC Minimum 5 years of progressively responsible e‑discovery and litigation support experience, including hands‑on involvement in complex civil litigation, regulatory investigations, or government inquiries Working knowledge of the Federal Rules of Civil Procedure, particularly Rules 26, 34, and 37(e) as they relate to ESI discovery, preservation obligations, and spoliation; and familiarity with Massachusetts Rules of Civil Procedure Rules 26 and 34 and Massachusetts Superior Court Rule 30A governing written discovery and ESI procedures Excellent written and verbal communication skills Strong analytical and problem‑solving skills, including the ability to evaluate large datasets and develop efficient discovery strategies Professionalism when working with demanding clients and senior attorneys Ability to balance and prioritize competing priorities and responsibilities Highly organized with extreme attention to detail Ability to collaborate and work effectively in team settings Demonstrated experience managing e‑discovery vendor relationships and coordinating with forensic consultants and litigation support professionals Technical and Legal Expertise Proficiency with leading e‑discovery platforms, including RelativityOne (Review Center, aiR, and Analytics), for document review, privilege analysis, and strategy development Ability to validate TAR/CAL/GenAI document reviews using basic statistical metrics and required industry‑standard validation Experience conducting client data identification and collection calls, including developing collection plans, coordinating with IT personnel, and understanding data sources across enterprise systems (e.g., Microsoft 365, Google Workspace, Slack, and mobile devices) Proficiency in negotiating and implementing ESI agreements, protective orders, and TAR/CAL/GenAI protocols Understanding of the Electronic Discovery Reference Model (EDRM) and its practical application across all phases of the e‑discovery lifecycle Knowledge of digital forensic collection concepts and tools (e.g., Cellebrite, Microsoft Purview, Google Vault) and ability to coordinate with forensic specialists on evidence preservation and collection The salary range for this position in Boston is $200,000‑225,000.
