The California Consumer Privacy Act (CCPA) becomes effective January 1, 2020. The legislation was signed into law in 2018, and the draft proposed regulations were made available for public comment on October 10, 2019. While not yet finalized, the draft regulations do provide important guidance to affected businesses and California residents about how to implement the new CCPA law.

  • Provides California residents with new rights to protect their personal information that is collected, used, shared or sold by certain businesses.
  • Businesses subject to CCPA must comply on or before January 1, 2020.
  • Covered businesses include certain for-profit entities doing business in California, including those who are and are not located in the state of California that meet certain conditions
  • Requires businesses to provide notice before or at time of collection of personal information

The California CCPA grants California residents several new rights intended to provide consumers with more control over their personal information and how it is used. These include the right:

  • To know what categories of personal information is collected, used, shared or sold, including the business purpose.
  • To delete personal information in possession of the business and/or associated third party service provider.
  • To Opt-out of the sale of personal information; and
  • To non-discrimination in pricing or service when consumer is exercising CCPA privacy rights.

A business subject to California’s new CCPA law is any business that:

  • Is a for-profit entity.
  • Does business in the State of California.
  • Collects personal information from California residents.
  • Meets one of the following:
    • Has annual gross revenues over $25,000,000.
    • Buy, receive for commercial purposes, sell or share for commercial purposes personal information of 50,000 or more consumers, households or devices.
    • Derive at least 50% of annual revenues from selling consumers personal information.
  • In addition, an entity that owns more than 50% of a business and shares common branding with the business is subject to the CCPA requirements.

Businesses subject to the CCPA are required to meet certain obligations under the new law, including comprehensive notice requirements. A covered business must provide a notice to consumers before or at the time personal information is collected. Employers subject to the CCPA must also provide notices to job applicants, contractors, new hires and current employees that are California residents. Notices must include specific details about the personal information collected by the business and meet other requirements, some of which includes:

  • The categories of personal information collected.
  • The business purpose of collecting and the use of the personal information.
  • A link or web address to access the business’s privacy policy.
  • Notice must be accessible to those with disabilities or provided in alternative way.
  • New notice is required prior to collecting new categories of personal information.
  • Businesses cannot use personal information other purposes not previously disclosed, unless they disclose and receive consent from California resident.
  • Create procedures to respond to consumer requests, maintain records of requests and responses and verify identity of the requestors.
  • Meet training and additional record-keeping requirements.

Under the CCPA, a consumer is defined as a “natural” person who is a California resident. For California CCPA purposes, any person who is a California resident and an employee of a business subject to the new law is a consumer of the business employing them. As such, employees (including, job applicants and contractors) are entitled to the consumer privacy rights provided under the regulations, except where certain temporary exceptions apply.

While the intent of the law is positive, it does not come without unintended consequences. For example, the CCPA’s “right to delete” personal information conflicts with other laws at the state and federal level in the employer setting. If an employer were to delete an employee’s personal information, upon the employee’s request pursuant to the CCPA; there is a greater potential for the employer to not be in compliance with several other laws related to labor, tax, employment and immigration.

To address the unintended consequences of the CCPA, legislation under AB 25 was enacted to provide a temporary exemption to some of the CCPA requirements when related to personal information used for employment purposes. During the period from January 1, 2020 through December 31, 2020, personal information considered employment data is exempt from most of the CCPA requirements. However, businesses subject to the CCPA are still required to comply with the CCPA privacy notice requirements for all applicants, employees and contractors. The one-year exemption only applies to personal data used for employment related purposes and does not apply to any other personal information a business may collect for other business purposes.

Business subject to the CCPA should document how they collect personal information and for what purposes the information is used, so that this information can be included in the business’s CCPA privacy notices. Paylocity has prepared a California Consumer Privacy Act Resource Guide to provide clients with additional materials and resources. The guide includes FAQs related to the application of the CCPA in the employment context, sample job applicant notices and employee notices. Additional guidance is also available to our clients on how to add the privacy notices for applicants and employees to their Recruiting and Onboarding modules. We encourage all employers subject to become familiar with the law’s requirements and to seek legal guidance to address questions on how to comply with the law.

This information is provided as a courtesy, may change and is not intended as legal or tax guidance. Employers with questions or concerns outside the scope of a Payroll Service Provider are encouraged to seek the advice of a qualified CPA, Tax Attorney or Advisor.
