Director Legal Senior

Our Director Legal Senior will lead a dynamic team of lawyers responsible for all legal matters in the region, while also contributing to global legal initiatives. The main goal of this position is to support the development and operations of Accor's premium, midscale, and economy hotel brands, as well as to drive the company's growth and business development in the NHAM region. In addition to this primary objective, this role will also provide support to all other areas of the headquarters.

The position includes drafting and negotiating hotel management agreements (HFA) and brand management agreements (HMA), as well as related contracts, and managing and mentoring a regional legal team. The senior legal director is also expected to address a wide range of issues, including conflict management, risk mitigation, and training internal business partners.

The role requires a person capable of structuring, managing, and negotiating cross-border transactions; communicating legal matters clearly and pragmatically to business stakeholders; supervising the legal team and providing guidance to external counsel when necessary; operating in diverse legal and cultural environments throughout the NHAM region; and effectively engaging with owners, their advisors, regulatory bodies, and internal stakeholders.

Requirements include:

• Leading and guiding the NHAM legal team, as well as retaining and, when necessary, attracting the right talent. Developing, directing, and motivating the team.
• Supervising external legal advisors and managing legal budgets.
• Advising on proposed operations, including aspects related to confidentiality agreements, structuring of operations, letters of intent, and interference with unlawful conduct.
• Drafting and reviewing hotel management agreements (HMA) and hotel franchise agreements (HFA).
• Advising and ensuring compliance with franchise requirements (including preparation of franchise disclosure documents), franchise disclosure laws and relationships, and other relevant laws, including competition defense and agency laws.
• Managing legal correspondence independently with internal departments and external contractual partners, particularly with external legal advisors/lawyers of contractual partners.
• Developing and sharing technical knowledge, particularly by creating agreement templates that maximize value and minimize risk, for use by the team and its internal clients.
• Advising operational and support services on contractual law issues. Responding to various operational issues with franchisees and owners, including quality assurance matters, and negotiating and drafting agreements related to property changes, terminations, and exits.
• Supporting corporate departments in ongoing disputes with owners and managing any litigation that arises.
• Supervising external lawyers and managing legal budgets.
• Providing strategic advice to operational and support services.
