Assistant Prosecuting Attorney - Civil Prosecutor

Job Summary Individual reports directly to the Chief of the Civil Division, Executive Administrator and the Prosecuting Attorney. The individual exercises independent judgment with direction. While candidates who are licensed to practice law in the State of Ohio are preferred, we will also be considering new graduates who are awaiting bar results. Responsibilities Advise clients of the Prosecuting Attorney on civil matters occurring in and affecting county government and/or township government. Advises clients on a variety of legal and business matters, including contracts, land use, zoning, purchasing, competitive bidding, employment law, public records, open meetings, real estate, taxation, development, procedure, construction law, election and levy law, and other issues affecting the Prosecuting Attorney’s clients. Perform legal research and draft opinions and memos on legal issues affecting the Prosecuting Attorney’s clients. Litigate all civil matters on behalf of the Prosecuting Attorney’s clients, as both plaintiff and defendant, before state and federal courts. Prosecute foreclosures and prepare appellate briefs and other documents for appeals of civil actions before all levels of appellate courts. Orally argue appealed actions and represent clients before various local, state, and/or federal administrative agencies and boards. Attend meetings of county and/or township boards as appropriate to provide legal advice, including evening meetings and meetings held both on and off site, which may occur outside normal working business hours. Draft, review, and approve contracts as to form. Provide public speaking, education of Prosecuting Attorney clients on legal issues, and present at conferences held by associations of which clients are members. Advise the Prosecuting Attorney on legal matters pertaining to the Prosecuting Attorney’s Office. Perform other duties as assigned by the Chief of the Civil Division and/or the Prosecuting Attorney. Be available outside normal working hours and days for urgent matters. Maintain a regular, predictable, and prompt physical presence in the office. Qualifications New graduates awaiting bar results. A Juris Doctor (JD) and being licensed to practice law in the State of Ohio are preferred. Must possess a valid State of Ohio Driver's License and have an acceptable driving record. Requirements Equipment Ability to operate normal office equipment such as computer, copier, fax machine, telephone, calculator, paper shredder, motor vehicle, and other equipment necessary to perform duties. Operate electronic and book legal research tools. Good understanding of and ability to use Microsoft Office (Word, Excel, Outlook, Power Point) and Internet browsers (Explorer and Chrome). Critical Skills and Expertise Thorough knowledge of Ohio civil statutes, case law, and procedure. Basic knowledge of the structure of Ohio government and its political subdivisions. Good trial and oral advocacy skills, including jury selection, authentication of documents and physical evidence, examination and cross‑examination of witnesses, and argument to bench and jury. Excellent legal research and writing skills. Excellent verbal and written communication skills. Ability to manage and direct a large, complex case load under the direction of the Prosecuting Attorney. Excellent interpersonal skills, with the ability to work with people of varied levels of education and competence. Good public speaking skills. Demonstrates integrity, reliability, and ability to maintain confidentiality. Ability to evaluate risks and exercise sound judgment, making decisions in complex and sometimes ambiguous situations that carry major implications for the people of Delaware County and or Townships located therein. Ability to work under pressure. Strong organizational skills. Ability to work as part of a team.
