To learn more about the NC Department of Labor, please visit our website at Description of Work This position reports directly to the East Bureau Chief of OSH Compliance and is responsible for planning, directing, and managing the daily operations of health and safety compliance activities for District 10, which encompasses 13 counties and is based in the Wilmington Field Office. The position is responsible for assuring that bureau goals, policies, practices, OSH standards (and other safety related regulations) and interpretations are effectively utilized by subordinate compliance officers to maximize efficient use of personnel and equipment supplied. In addition, this position will provide administrative and technical supervision over health and safety compliance officers in the areas of: accident investigations, complaint and referral inspections, general scheduled safety/health compliance inspections, special emphasis compliance programs, case file management, education and training, public speaking, internal training, equipment operation and maintenance, legal interpretations, engineering and design of protective safety systems, hazard abatement assistance, and research and development of new technologies and procedures. Furthermore, this position will ensure that assignments are appropriately distributed to field personnel to facilitate quality, timeliness and effectiveness of all completed tasks. Assurances of subordinate employees work quality, effectiveness, and efficiency is a key role for this position. This employee is also responsible for proposing and directing the implementation of occupational safety standards and policies. District activities include the inspection of workplaces within the State (public and private sector), issuance of citations with associated monetary penalties for violations of safety and health standards, investigations of occupational safety and health complaints and significant accidents/catastrophes (including those resulting in fatalities. The issuance of citations may lead to litigation/conferences with the employers and employees regarding cited conditions. This position is responsible for ensuring that all litigation is properly coordinated with the Attorney General’s office in accordance with established OSH Division policies. The health and safety compliance supervisor also participates in all pre/post contest negotiations (informal conferences/settlement negotiations). In the performance of these duties, the health and safety compliance supervisor provides technical and regulatory assistance directly to compliance officers, employers, and employees in regards to interpretation of Federal and State law, as well as measures to ensure that places of employment fully meet their responsibilities as employers under the Occupational Safety and Health Act of 1970. This position will review case file reports/inspection activity performed by subordinate compliance officers for technical content and to ensure that the following rules, regulations, statutes, and standards are appropriately used and enforced: Other areas that this position is responsible for includes overseeing district and area field office operations. These additional duties include, but are not limited to, interaction with the administrative staff, coordinating case file processing, coordinating the maintenance and upkeep of field offices (building facilities), coordinating the usage and maintenance of state motor fleet vehicles, and coordinating the maintenance, operation and upkeep of an office-based computer network system. Variety and Purpose of Personal Contacts: This position has extensive contact with the general public, employers, employees and governmental officials. This employee must communicate effectively, both inside and outside the agency. The supervisor is required to conduct informal conferences, perform technical assistance and to negotiate and resolve all case file problems. Additionally, this employee participates in contested case hearings providing guidance and testimony. These communications often require interfacing with corporate executives, attorneys, and elected officials. In addition to these negotiations, this employee may be called upon to speak to the public regarding a wide variety of Occupational Safety and Health issues. Speeches are made about standards, safety related topics, and the Divisions policies and procedures. Groups addressed include professional associations, safety and health schools, trade associations, public/private sector employees/employers, and Committees considering promulgating new laws/standards. The contact is generally on a daily basis. This position is required to communicate effectively in written and oral modes. This communication is in response to often difficult and complex queries concerning rights and duties of employers/employees and procedural queries from attorneys, corporate legal staff, federal staff, and elected officials. This employee is involved in the coordination and evaluation of all aspects of district work, giving guidance and direction to health and safety compliance officers. Physical Effort: A majority of the work is performed in an office setting. However, this employee will visit N.C. work sites and be subject to an almost unlimited variety of safety and health hazards. Therefore, the job may require climbing, walking, and the use of Personal Protective Equipment (respirators, hearing protection, etc…). The employee is required to have (and pass) an annual physical to ensure that job duties can be performed. The results of the physical are reported to the Division. Work Environment and Conditions: This employee works in an area office that is owned or leased by the North Carolina Department of Labor. Travel is required to field locations, field offices and inspection/speaking sites. The employee also travels to attend conferences, meetings and training sessions. Machines, Tools, Instruments, and Materials Used: This employee must demonstrate proficient knowledge and use of a wide variety of occupational safety and health measuring devices. In addition to using this equipment, this employee must ensure that all health and safety compliance officer subordinates receive sufficient training in the use, calibration and maintenance of this equipment. The equipment used includes, but is not limited to, the following: air sampling devices, noise dosimeters, sound level meters, radio frequency meters, infrared analyzers, velometers, thermoanometers, multi-gas direct reading instrumentation, light meters, dynameters, heat stress monitors, Personal Protective equipment (respirators, ear plugs, ear muffs, hardhat, glasses/goggles, Tyvek suit, safety shoes, reflective vests harness/lanyards), receptacle circuit tester, pocket penetrometer, torvane shears, detector tubes/pump, calipers, tape measure, copier/scanner, facsimile machine, audio/visual equipment, digital camera and printers. Safety for Others: This employee is responsible for ensuring that district and area office employees perform their job in a safe manner. This employee manages and supervises a health and safety compliance district, and the activities of the district/Bureau affect the safety and health of all employers/employees in the State of North Carolina. Dynamics of Work: The parameters of the work for this position are constantly changing; therefore, this employee must be flexible and have the ability to adapt to constant changing conditions. New laws, standards, regulations, guidelines, policies and interpretations are issued frequently, and this position must stay abreast of these changes, and also make efforts to keep safety compliance officers, employers, employees and departmental management informed of these changes. Changes in equipment technologies require constant training/updating to maintain district/area office operations at a modern level. Additionally, it is foreseen that safety and health hazards will increase in the workplace as new technologies, products, and materials emerge (which will make it even more important to keep abreast of these changes). Considerable knowledge of federal and state safety and health codes and eligibility requirements for statewide awards programs. Extensive working knowledge of strategic planning techniques, complex database management systems and team building. Ability to understand and interpret laws, standards, regulations applicable to specific work site situations and statistical data. Ability to establish and maintain effective working relationships with management, State and Federal officials, and the general public. Ability to communicate effectively in written and oral form. Ability to train and supervise other workers. Ability to use various types of inspection testing and measuring equipment. Preference will be given to applicants with progressive supervisory experience in the occupational safety and health field, demonstrated knowledge of OSHA regulations, compliance and enforcement practices, and experience managing staff and directing complex investigations.
