For an  over-the-road (OTR) non-CDL 26-foot box-truck driver , the requirements are different from a local delivery driver because the driver will be operating  interstate .

The key issue is the  GVWR on your specific truck . A 26-foot box truck can be non-CDL, but the vehicle generally needs to be  under 26,001 lbs. GVWR for a regular driver’s license to be sufficient. FMCSA confirms that a vehicle under 26,001 lbs. can be operated without a CDL, although it can still be a federally regulated commercial motor vehicle if it is 10,001 lbs. or more. 

OTR NON-CDL DRIVER — REQUIREMENTS FOR APEX

I would require applicants to have:

Driver requirements

• Valid U.S. driver’s license
• At least 21 years old for interstate driving
• Acceptable driving/MVR history
• Ability to pass your company’s road test
• Reliable and willing to travel OTR
• Ability to legally work in the U.S.
• Ability to pass a DOT physical
• Valid  DOT Medical Examiner’s Certificate (medical card)

For interstate commercial driving, FMCSA requires a DOT medical certificate when the vehicle has a GVWR/GCWR/GVW/GCW of 10,001 lbs. or more . 

Your driver qualification file

Apex should maintain a  Driver Qualification File (DQF)for every driver. It generally includes:

• Employment application
• Driver’s license information
• Motor Vehicle Record
• Previous-employer driving-history inquiries
• Road-test certificate or qualifying equivalent
• DOT medical certificate
• Annual MVR review
• Annual review/certification of violations

FMCSA requires motor carriers to maintain a qualification file for each driver. 

OTR hours & ELD

Because this is an OTR position, the driver will generally have to follow  FMCSA Hours-of-Service rules . FMCSA’s current guidance says most CMV drivers operating in interstate commerce must comply with HOS rules, including applicable limits on driving and on-duty time. 

If your truck is 10,001 lbs. or more , you should also determine whether the driver needs an  ELD . There are specific ELD exemptions, so you shouldn’t automatically assume every non-CDL driver is exempt. 

  Drug testing — important distinction

If your truck  does NOT require a CDL , the federal DOT CDL drug/alcohol testing program under Part 382 generally does  not apply solely because the driver is operating a non-CDL truck. The CDL requirement is what triggers that particular federal testing program. 

However, you can still have your own company drug-testing policy, and other requirements can apply depending on the operation.
