Hearing Officer 1 (Hourly)

Hearing Officer Duties Description Preside over administrative matters (including pre-hearing conferences, status conferences, and hearings) where the subject of a substantiated report of abuse or neglect challenges that determination; rule on various issues including objections by parties, relevancy and admissibility of evidence and exhibits, and requests for adjournment; consider and evaluate documentary and testimonial evidence; consider and evaluate lay and expert testimony; and apply appropriate laws and regulations to the facts and evidence. Follows proper office procedures; ensures that each matter is scheduled effectively within guidelines; and maintains proper documentation of each administrative matter. Maintain order and control of each appearance while remaining respectful. Issue reports and recommendations, setting forth the determination of the issues at the conclusion of the hearing. The report and recommendation will include reasons and factual basis for the determination, a description of the issues, a recitation of relevant facts, an assessment of the credibility of testifying witnesses, the applicable statutory and regulatory authority, findings of fact, conclusions of law and a recommendation to the Executive Director. Utilize legal research techniques and have strong analytical skills and communication skills, including both verbal and written. Review new legislation, regulations and other developments that have an impact on the conduct of hearings or on hearing decisions, and study court cases having an impact on the hearing process. Minimum Qualifications Current New York State employee with one year or more permanent, contingent-permanent or 55b/c service as a Hearing Officer 1 and are interested in reassignment; OR Current New York State employee with one year or more of permanent, contingent-permanent, or 55b/c service in a position allocated to a Grade 23 and eligible for transfer under Section 52.6 of the Civil Service Law.

NY-HELPS NON-COMPETITIVE MINIMUM QUALIFICATIONS:

Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agency.
