The Comal County Criminal District Attorney’s Office is seeking an experienced and trial-tested Attorney, Felony I to serve as a lead prosecutor in one of the county’s five felony district courts. SALARY AND BENEFITS
The annual salary is $124,503.60 – $145,000 DOE/DOQ, PLUS a generous benefits package. This position requires comprehensive knowledge of all aspects of criminal prosecution and law enforcement procedures. It involves prosecuting adult felony offenders in the District Courts, maintaining daily contact with the public, and assisting the Criminal District Attorney with case trials and the handling of all criminal law matters. The role is also responsible for ensuring that prosecutions are conducted appropriately, based on the facts and the application of current law. To perform this job successfully, an individual must be able to perform each essential duty satisfactorily. Duties include the following: Act as lead prosecutor for the court, as assigned by the Chief Felony Prosecutor. Mentor and assist Felony II prosecutor in all court proceedings, as assigned by the Chief Felony Prosecutor. Responsible for all-level felony cases assigned through intake process. Responsible for managing a larger caseload from intake through disposition. Performs case intake, screening of cases, and follow-up on investigation status to include review of reports and evidence submitted by law enforcement agencies. Make charging decisions and presents appropriate cases to the Grand Jury for indictment. Responsible for managing criminal dockets in assigned District Court. Reviews offense reports and discovery logs to ensure that all discovery has been made available to defense counsel. Prepares for and attends arraignment dockets, pre-trial hearings, bond hearings, and revocation hearings. Ensure court dockets have been appropriately prepared for each docket. Make appropriate plea offers upon reviewing evidence, criminal history, police reports and other relevant information. Negotiate plea offers and discuss relevant legal issues with defense counsel. Prepares for court hearing and trials, to include reviewing evidence, interviewing witnesses (victims, civilians, law enforcement, and experts), preparing and/or reviewing trial motions, responding to defense motions, preparing court exhibits and conducting hearings and trials. Conduct trials (bench or jury) weekly. Represent the State of Texas in jury trials and must be well prepared to conduct jury selection, opening statements, witness examination (direct and cross), closing statements, and drafting jury charges. Perform complex legal research and maintain up-to-date knowledge of the law. Appellate work is not required, but opportunity is available as court schedule allows. Performs all other job-related duties, as assigned by the Chief Felony Prosecutor and/or Criminal District Attorney. Provide support and assist other court teams as necessary. Collaborates with the Criminal District Attorney and other Felony I prosecutors on various felony cases as needed. Attends all meetings and trainings, as required. EDUCATION and/or EXPERIENCE A high school diploma or GED equivalent is required. A bachelor's degree (BA) from a four-year College or university and a J.D. (law) degree are required. Three (3) years of experience as an attorney practicing criminal law. Significant Felony Jury trial experience. The individual should possess a thorough working knowledge of law enforcement and court procedures and practices.CERTIFICATES, LICENSES, REGISTRATIONS
