Reports to: Director of Litigation FLSA Classification: Exempt

Summary / Objective

The Senior Attorney, Litigation handles mortgage‑related litigation files as lead counsel in State and Federal courts in Texas. Responsibilities include drafting and filing pleadings and motions, managing cases from inception through resolution, and representing clients in contested matters and hearings. Daily communication with clients, borrowers, and opposing counsel is required. Court appearances and hearing attendance are mandatory. This is an in‑office position.

Essential Functions

• Provide legal advice to the Firm’s mortgage servicing clients; communicate via phone, email, and client database systems.

• Research and analyze legal sources including statutes, judicial decisions, legal articles, treaties, constitutions, and legal codes.

• Prepare legal briefs, pleadings, appeals, contracts, and other necessary legal documentation for State and Federal litigation.

• Handle civil litigation cases from referral through resolution, including written/oral advocacy, motion practice, discovery, trial preparation, trial, and appellate briefing/argument.

• Participate in mediation; demonstrate ability to understand complex loan documentation and loss mitigation processes.

• Review work product of staff (legal assistants and processors) for accuracy.

• Maintain current knowledge of trends, regulations, and legislation affecting the practice area.

• Settle cases and attend hearings.

• Perform additional duties as assigned.

Qualifications

Position Preferences:

• Juris Doctorate.

• Licensed to practice law in Texas State and Federal Courts.

• Seven or more years of experience preferred in finance or representation of financial institutions in real estate‑related matters.

• Exceptional oral and written communication skills.

• Ability to work through complex mortgage‑related issues.

• Proficiency with PC systems and ability to adapt quickly to various database platforms, including Microsoft Word.

• Ability to represent the company professionally in various forums.

Working Conditions

This position operates from the Dallas office. Occasional travel to other Firm office locations may be required. Standard office equipment (computer, phone, copier, fax) will be used.

Physical Requirements

The employee must be able to talk and hear regularly. Frequent standing, walking, and use of hands to handle or feel objects is required. Occasional lifting of office products and supplies up to 20 pounds may be necessary.

Position Type and Expected Work Hours

This is a full‑time position. Work hours are Monday through Friday, 8:30 a.m. to 5 p.m. Reliable transportation is required to meet in‑office schedule expectations.
