Pre-Suit Attorney (Trucking) (Miami-Fort Lauderdale Area)
Anidjar & Levine P.A.
About the Firm
Anidjar & Levine, P.A. is a technology-forward personal injury law firm driven by a single core purpose: fighting for people when it matters most . Our clients are not just a number — every client gets the attorney's cell phone number and nets one-third of the recovery. The Pre-Suit Attorney is central to delivering on those promises, guiding clients from case opening through resolution or Suit referral while leading the team that supports them every step of the way.
Role Summary
The Pre-Suit Attorney manages a caseload of personal injury matters from intake through pre-suit resolution or transition to litigation. This role requires a hands-on attorney who can assess liability, direct medical treatment strategy, negotiate settlements, cover recorded statements and examinations under oath with the insurance carriers, and attend mediations.
This is a practicing attorney role focused on case strategy, client relationships, and results. The Pre-Suit Attorney works closely with case managers (who report to a dedicated middle management layer) and provides input and guidance on case progression.. In a firm where every client gets the attorney's cell phone number, accessibility and responsiveness are not optional — they are the expectation.
Core Responsibilities
Case Assessment & Strategy
- Evaluate new cases upon assignment, including review of police reports, accident facts, and initial client interviews to assess liability and case viability.
- Identify witnesses, preserve evidence, and develop a case theory early in the process.
- Determine appropriate medical treatment paths (hospital care, chiropractic, orthopedic, pain management, surgery, etc.) and monitor treatment progression to ensure it supports the client's claim.
- Identify coverage issues early, including policy limits, UM/UIM applicability, and third-party liability.
- Assess and direct the resolution of property damage claims to client vehicles.
Client Relationship & Communication
- Serve as the primary attorney contact for each client on your caseload, consistent with the firm's promise that every client gets the attorney's cell phone number.
- Communicate with clients regularly to provide case updates, explain next steps, set expectations, and answer questions.
- Ensure clients understand the process, feel informed, and never feel like just a number.
- Conduct client meetings (in-person or virtual) as needed to review case status, prepare statements or mediations, and discuss settlement options.
Demand Preparation & Negotiation
- Review and approve demand packages prior to submission to insurance carriers, ensuring medical records, bills, and case narratives are accurate, complete, and persuasive.
- Negotiate settlements directly with insurance adjusters and defense counsel, pursuing maximum recovery for clients.
- Evaluate settlement offers against case value and advise clients accordingly.
- Attend and advocate at pre-suit mediations.
Pre-Suit Legal Proceedings
- Conduct or coordinate Examinations Under Oath (EUOs) appointments.
- Prepare clients for EUOs, recorded statements, and other pre-suit proceedings.
- Monitor statute of limitations deadlines and ensure timely action on all cases.
- Determine when a case should transition to litigation and coordinate a thorough handoff to the Hybrid team.
Collaboration with Case Managers
- Provide input, guidance, and feedback to case managers on case strategy, medical treatment timelines, and demand preparation.
- Participate in case reviews with case managers to ensure cases are progressing appropriately and client needs are being met.
- Communicate case priorities and time-sensitive matters clearly so case managers can act accordingly.
- Escalate case management concerns to the appropriate middle management supervisor as needed.
- Technology & Systems
- Utilize our firm's case management software, communication tools, and document management systems proficiently. e.g., Filevine
- Ensure case files are maintained accurately and completely in the firm's systems.
- Leverage technology for case tracking, deadline management, and client communication to maximize efficiency.
Required Qualifications
- Juris Doctor (J.D.) from an accredited law school.
- Active member in good standing with the Florida Bar.
- Minimum 3 years of experience handling personal injury pre-Suit matters, including case evaluation, demand preparation, and settlement negotiation.
- Demonstrated experience with motor vehicle accident and premises liability claims.
- Strong written and verbal communication skills.
- Ability to manage a high-volume caseload while maintaining quality and client responsiveness.
- Experience reviewing medical records and understanding treatment timelines as they relate to case value.
- Comfort with technology and willingness to adopt firm systems and tools.
- Strong organizational skills with acute attention to deadlines and detail.
Preferred Qualifications
- 5+ years of pre-Suit personal injury experience.
- Prior experience collaborating with case managers and support staff in a high-volume pre-Suit environment.
- Experience attending and advocating at pre-suit mediations.
- Familiarity with Florida PIP, BI, UM/UIM, and property damage claim processes.
