Job Summary Located in the nation’s capital, the Office of the Attorney General (OAG) is the chief legal office of the District of Columbia. OAG enforces the District’s laws, works to protect and defend D.C. residents, and provides the highest level of independent legal advice and guidance to District of Columbia government agencies. This position is in the Antitrust and Nonprofit Enforcement Section of the Public Advocacy Division (PAD). The Antitrust and Nonprofit Enforcement Section (ANP) seeks an experienced litigation attorney to represent the District of Columbia in investigations and civil litigation arising under the District of Columbia Antitrust Act and federal antitrust statutes, and based on the Section’s needs, the Nonprofit Corporation Act and related common law. PAD investigates and litigates affirmative civil cases aimed at protecting the public interest. ANP is one of five sections within PAD and focuses on anticompetitive conduct and the failure of nonprofits to serve their public purposes. The Section prosecutes a wide range of cases, including cases seeking damages or injunctive relief for violations of the antitrust and nonprofit and charities laws. The attorney in this position will primarily handle cases involving antitrust investigations and litigation, and may also work on nonprofit matters, which involve conduct that may include use of nonprofit funds for improper purposes as well as improper constitution or management of the nonprofit corporations. The District brings nonprofit matters pursuant to its authority under the District’s Nonprofit Corporations Act and the common law. Finally, in rare instances the attorney may work on other types of matters handled by PAD, including but not limited to consumer protection, environmental, workers’ and civil rights, and fraud against the District. Additionally, while many of PAD’s cases are filed in DC Superior Court, the District also regularly participates in multistate and state‑federal coalitions investigating and litigating antitrust actions. Duties and Responsibilities Litigate complex civil cases involving violations of District and federal antitrust laws at all phases of litigation, including investigation of mergers and non‑merger conduct, pleadings, discovery, motions practice, trial, appeal, and settlement; prepare witnesses and exhibits; collect and organize evidence; prepare and conduct preliminary proceedings; work with experts; examine witnesses; deliver oral arguments; and conduct administrative functions relating to litigation. Manage nationwide and local litigation to promote the District’s efficient and impactful participation in antitrust cases throughout the United States. Participate in complex multi‑state investigations, negotiations, and litigation on behalf of the District. Regularly interact with colleagues, members of the public, law enforcement, and fellow governmental agencies regarding the work of the Section and create and deliver training to these entities when needed. Research federal and state laws relating to our antitrust claims to ensure that our investigations and litigation maintain a strong legal footing; remain abreast of relevant judicial and policy developments in antitrust and related areas. Travel (both within the District and nationwide) when needed for investigations, court appearances, hearings, and trials. Work alongside management to identify the Section’s training needs and improve structures and processes in the unit. Serve as a team lead for both investigations and litigation, overseeing other attorneys, investigators, paralegals, and others, while providing mentoring, coaching, and professional growth opportunities to those on the team. Serve as a mentor and resource to junior attorneys in the unit, including, for example, providing guidance on investigation or litigation strategy and reviewing certain types of work product, including court filings in District or federal court. Perform other related duties as assigned. Qualifications and Education The incumbent must have a law degree and be a member of the District of Columbia Bar or eligible for waiver into bar. At least 10 years of relevant specialized experience, including at least 1 year at an equivalent level to LA‑14. Strong civil litigation experience, familiarity with federal antitrust practice, strong legal research and writing skills, and the ability to work independently and exercise strategic and legal judgment. The candidate must be able to analyze complex factual issues to identify and prosecute potential violations and be able to handle several complex matters at one time. Familiarity with industrial organization or microeconomics is helpful for the ANP’s antitrust work but is not required. Licenses and Certifications The incumbent must be sworn into the District of Columbia Bar within 360 days of initial appointment with the Office of the Attorney General. Working Conditions / Environment Work is generally performed in an office setting. The work is sedentary, with some walking, handling, and carrying of light to moderately heavy objects such as case records, briefcases, and exhibits. Other Significant Factors Type of Appointment: Legal Service (LS) – Regular Pay Plan, Series and Grade: LS‑0905‑15 Salary: The maximum salary for this position is $165,601 Number of Vacancies: One (1) Tour of Duty: Monday‑Friday; 8:45 am‑5:15 pm In‑person reporting with limited telework and flexible work schedules available upon eligibility. Promotion Potential: No known promotion potential. Collective Bargaining Unit: This position is in the collective bargaining unit represented by AFGE Local 1403. Residency Preference: Applicants claiming “Residency Preference” will be required to maintain residency in the District of Columbia for a minimum of seven (7) years.
