Attorney II/Attorney III

$10 per hour

AC Transit

The District seeks a qualified attorney to fill a position within the Office of the General Counsel. The District may fill this position at either the Attorney II or Attorney III level. Appointment will be based upon the selected candidate’s qualifications, depth of directly related professional experience, demonstrated competencies, and the operational needs of the District. This recruitment is intended to support the District’s broad legal service needs and may involve assignments in areas including contracts, labor and employment, regulatory compliance, procurement, real estate, and public agency law. Under direction, incumbents perform a broad range of professional legal work of moderate to high complexity on behalf of the District. Incumbents provide legal counsel and representation to District management and staff; prepare and review legal documents and agreements; assist with administrative matters with minimal direction from higher‑level legal staff. Work assignments require discretion, sound judgment, strong analytical and communication skills, and the ability to independently manage varied legal matters to support efficient operations, legal compliance, and risk mitigation. This is an unrepresented, at‑will classification. Investigates, researches, and prepares oral and written advice to the Board of Directors and District personnel on complex legal matters affecting a public transit district. Oversees all phases of assigned legal matters and litigation involving the District, including investigations, pleading, discovery, depositions, hearings, arbitrations, trials, and appeals. Drafts and analyzes resolutions, memoranda, contracts, and other legal documents. Exercises discretionary and independent judgment commensurate with the acquisition of specialized legal skills and experience. Represents the District in administrative hearings. Negotiates, prepares, drafts and reviews agreements, preliminary reports, title policies, grant proposals, Board reports, letters, licenses, interagency cooperative agreements, contracts, deeds, leases, ordinances, resolutions, legislation, and other legal documents and instruments; offers opinions as to legal adequacy. Advises District personnel on general liability risk management matters including contractual risk and assessment of first‑party and third‑party liability claims. Represents the District, and its officers and employees, in litigation including preparation of pleadings, briefs, and other litigation documents, court appearances, motion practice; partners with and supports outside counsel representing the District. Monitors and analyzes current legislation, regulations, administrative law and case law for impact on District business and operations. Represents the General Counsel’s Office at various Board of Directors and committee meetings. Serves as a liaison for the legal program with other District departments and outside agencies. Under general direction, conducts settlement negotiations and recommends settlement amounts and details to the General Counsel or Assistant General Counsel. Assists Department Heads and staff in establishing operational policies by developing and applying legal analysis; recommends changes to department policies and procedures to meet changing legal requirements. Meets and negotiates with outside parties in matters arising out of claims, property transactions, and other District business. Attends and participates in professional group meetings; stays abreast of new trends and innovations in the field of public agency law. Performs related duties as required. Education – Attorney II & Attorney III Possession of a Juris Doctor (JD) degree from an accredited school of law. Experience – Attorney II Three (3) years of recent and verifiable experience as a practicing attorney in civil or government law, including demonstrated trial experience and experience taking depositions; or an equivalent combination of training and experience, including at least two (2) years performing duties at a level equivalent to the District’s Attorney I classification. Experience – Attorney III Five (5) years of recent and verifiable experience as a practicing attorney in civil or government law, including demonstrated trial experience, with at least two (2) years performing duties at a level equivalent to the District’s Attorney II classification. License and Certification(s) Possession of an active membership in good standing with the State Bar of California. Desirables Strong experience in contract drafting, review, negotiation, and administration within a private‑sector environment is highly desirable. Candidates with recent experience in government transactional law, including public agency contracting, procurement, regulatory compliance, and related municipal or special district legal matters, are also highly desirable. Special Requirements 1. Must be able to travel throughout the Bay Area and within subpoena distance for trials, hearings, depositions, and arbitrations. 2. Must be able to attend meetings outside of regular business hours. Physical Requirements Must maintain the physical condition necessary to: (1) perform tasks in an office setting operating a personal computer, keyboards, and other peripheral equipment; and (2) possess physical mobility in order to attend off‑site trials, hearings, negotiations, and to attend external meetings and events. Position Classification This position is unrepresented at will. Current District employees must have satisfactory attendance and performance records. Finalists will be placed on an Eligibility List. When filling vacancies, Human Resources will refer the top candidates to the hiring department for final screening and recommendation. Benefits Medical – Choice of two Health Maintenance Organizations (HMOs): Kaiser Permanente and Health Net. $10.00 office visit co‑pays; $5.00–$35.00 prescription co‑pays. Dental – MetLife Preferred Provider Organization (PPO) $50 annual deductible per person/$150 per family; $3,000 per person annual maximum; preventative care covered at 100%; basic and major care covered at 90%; $4,000 lifetime maximum orthodontia covered at 50%. Vision – Vision Service Plan – $10.00 copay; eligible for an exam, lenses, frames or contact lenses every 12 months – based on the last date of service. $200 frame allowance or $120 allowance for contact lenses. All employees hired on or after January 1, 2016 may be in the District's Tier II pension plan covered by the Public Employees' Pension Reform Act of 2013 (PEPRA).
