Junior Litigation Attorney

The Florida Legislature is seeking to fill a Senior Attorney position available with the Joint Administrative Procedures Committee. The Joint Administrative Procedures Committee is a committee of the Florida Legislature that maintains a continuous review of administrative agency rules to identify those that may exceed authority delegated to the agency by the Florida Statutes. The committee also generally reviews other agency action taken pursuant to the Administrative Procedure Act and makes recommendations for needed statutory changes. Financial Disclosure : Pursuant to sections 112.3144 and 112.3145, F.this position is required to electronically file a Form 1 – Statement of Financial Interests with the Florida Commission on Ethics within 30 days of hire. Reviews agency action pursuant to Chapter 120, the Administrative Procedures Act, to identify instances of the invalid exercise of delegated legislative authority; monitors Florida court cases and administrative decisions and advises agencies accordingly; reviews statutes passed each session and calls to the attention of the agencies all those which may require administrative rule promulgation, repeal or amendment. Recommends needed changes to legislation based upon trends in case law, agency comment or citizen request. Performs legal research concerning the interpretation of state and federal statutes and on other matters to assist with member and constituent inquiries. Reviews agency action pursuant to Chapter 120, the Administrative Procedures Act, to identify instances of the invalid exercise of delegated legislative authority; monitors Florida court cases and administrative decisions. Maintains communications with legislative committees, state agencies, and other stakeholders. Maintains communications with agency heads, or their assigned deputies, assistants, and agency general counsel. Knowledge of Florida laws and legal procedure. Skill in reading comprehension, analysis, research, and organization. Ability to interpret state and federal legislation, laws, and rules. Ability to employ legal reasoning and to foresee possible legal concerns. Ability to communicate effectively and concisely, both orally and in writing. Ability to perform legal writing and prepare various legal documents. Attorney in good standing with The Florida Bar and two years of professional experience in the practice of law, legal research, teaching law, or in administrative or judicial hearings. the Administrative Procedure Act. Ability to review statutes and determine if administrative rule promulgation, repeal or amendment is required. Ability to prepare letters and legal opinions involving statute and rule interpretation. Ability to research legal documents and legal references. Ability to perform legal research concerning the interpretation of Florida Statutes and on other matters in question for members and staff of the Legislature. Application Deadline
