Job Description and Duties
The State Water Resources Control Board's Office of Chief Counsel is seeking an Attorney V for one of the Regional Water Boards Legal Services branches. The Attorney V will be assigned as legal counsel to one or more of the nine regional water quality control boards.
The position location is 1001 I Street, Sacramento, CA 95814.
Duties: The regional water quality control boards are the primary planning, permitting and oversight agencies under the Clean Water Act and Porter-Cologne Water Quality Control Act within their respective jurisdictions. The Office of Chief Counsel provides legal counsel to the regional water boards, each of which has one to three attorneys who handle virtually all of the region's water quality law issues. The practice is varied and interesting. It includes participation in the most complex administrative adjudications and general representation of the seven-member boards and assisting in civil litigation involving the board's actions. Board attorneys work independently in a fast-paced, collegial environment.
Under the general direction of an Attorney, Assistant Chief Counsel, the Attorney V advises regional water board members, management, and staff in the most complex matters relating to water quality control planning, waste discharge permitting, enforcement, underground storage tank, and other environmental cleanups under the Clean Water Act, the Porter-Cologne Water Quality Control Act and other state and federal laws. The Attorney V also advises on the California Environmental Quality Act, Administrative Procedure Act, Public Records Act, Bagley-Keene Open Meeting Act, environmental justice, and related issues, and assists and works with the Attorney General in litigation involving the regional water board. The Attorney V provides legal advice in the most difficult and complex agency and litigation decision making on water quality issues, and requires a high level of expertise and independence, as well as the skills and experience to develop and work with innovative and novel legal theories.
