JOB SUMMARY

Attorney II

Performs moderately complex legal work including research, drafting, litigation, municipal prosecution, and counsel to the County and/or County officials.

ESSENTIAL JOB FUNCTIONS

• Legal Research & Counsel: Assists and conducts moderately complex legal research; drafts and/or prepares, under some supervisory review, written/oral legal opinions for departments and officials.
• Legal Correspondence: Drafts and prepares correspondence with opposing counsel, inquiries from the public, and correspondence from departments and officials, with some supervisory review.
• Contract/Legislative Drafting: Drafts, reviews and/or redrafts contracts, resolutions, executive orders, legislative orders, County Council rules of procedure and ordinances.
• General Litigation: Represents and/or assists in the representation of the County in civil and municipal trial and appellate court proceedings and administrative hearings; drafts and files, under some supervisory review, pleadings, memoranda, briefs, and motions; attends court and/or administrative appearances, and handles subpoenas, depositions and discovery requests; prepares and/or assists in the preparation for trial.
• Municipal Prosecution: Reviews traffic, criminal, code and animal violations issued by the local issuing authority, issues or refuses charges, and prosecutes cases to disposition
• Land Use Matters: Reviews and addresses matters related to planning, zoning, subdivision controls, and county codes related to erosion and settlement controls and flood damage prevention, and variances/deviations from county code.
• Condemnation Proceedings: Reviews and addresses matters in condemnation proceedings under Chapter 523, RSMo., and the Uniform Relocation Act, and regarding acquisitions generally under supervisory review; prepares the needed Bills and documents needed to proceed with the exercise of eminent domain through condemnation proceedings and prosecution of condemnation actions in Circuit Court, under supervisory review.
• Negotiation and Settlements: Negotiate plea agreements; assist in civil settlements consistent with policy and in the best interest of the County.
• Mental Health Detention Hearings: Represent local hospitals in involuntary mental health detention hearings.
• Professional Development: Maintain CLE compliance..
