Position Title Title IX Investigator Position Type Regular Hiring Range $81,850-$102,800 annually; Pay Frequency Annual POSITION PURPOSE This position supports the Office of Equal Opportunity and Title IX. In support of the University’s mission, values and goals, this position leads investigations. Under the direction of the Director of Equal Opportunity & Title IX Coordinator, the EO/Title IX Investigator primary responsibility will be to conduct investigations into allegations of sexual misconduct, sexual assault, harassment, discrimination, bullying, and/or retaliation by students, faculty, or staff of clients, and to produce well‑written, comprehensive reports that include clear, comprehensive fact‑finding and analyses as needed. Tasks will include interviewing parties/witnesses, collecting evidence, organizing evidence, making evidence available for review in keeping with SCU procedures, and drafting high quality investigation reports within established timelines. The EO/Title IX Investigator will be expected to write in‑depth analyses that include reliability and credibility determinations, fact‑finding, and, when appropriate, policy‑findings. The EO/Title IX Investigator will be expected to engage in fact‑gathering, crafting witness and/or evidence logs, and determining which facts are disputed or undisputed. EO/Title IX Investigators are also expected to draft clear, understandable, and error‑free investigation communications. The EO/Title IX Investigator is expected to follow relevant policies and procedures at all times, while also adhering to best practices for investigations and other resolutions. The EO/Title IX Investigator may also be asked to serve as an informal resolution officer or otherwise assist with other elements of a client’s complaint response and resolution process. ESSENTIAL DUTIES AND RESPONSIBILITIES EO/Title IX Investigations (85%) Conduct prompt and thorough investigations, including development of an investigative plan, identifying, and interviewing witnesses, gathering and securing information and data, keeping accurate and thorough records and notes of the investigatory process. Draft essential, error‑free correspondence related to processing of complaints. Engage in informal resolution practices to address complaints, concerns, or allegations when appropriate, and document accordingly. Understand and adhere to Santa Clara University standards and processes for investigations, resolutions, and report writing. Follow any policies or procedures as set forth by Santa Clara University, including timelines. Conduct interviews, take accurate notes, and draft interview summaries. Ability to independently determine appropriate questions to ask, information to document, and communications that may be necessary for any resolution process. Ask appropriate questions during interviews to gather information about allegations of sexual misconduct, discrimination, retaliation, or harassment. Be able to identify and distinguish between evidence that is directly related and/or relevant. Prepare comprehensive timely written reports, including in‑depth analyses. Prepare for and participate in meetings, hearings or grievances related to results of investigations. Stay abreast of regulations and statutes relating to discrimination, retaliation, harassment, sexual misconduct, and gender‑based violence including, but not limited to, Title II, Title VI, Title VII, Title IX, Section 504 of the Rehabilitation Act, the ADA, the FMLA, VAWA, and the Clery Act. Work with confidential and highly sensitive information and maintain confidentiality in compliance with Santa Clara policies, procedures, and state and federal regulations. Maintain an appropriate professional demeanor at all times. Complete other tasks and projects as assigned. Title IX Education and Reporting (15%) Assist Deputy Title IX Coordinator with creating and disseminating educational materials, including brochures, posters, and web‑based materials that inform members of the campus community of rights and responsibilities. Conducts outreach and education as part of awareness campaigns. Assist Deputy Title IX Coordinator with providing education, training, and outreach and engagement programming related to Title IX and the University’s discrimination, harassment, and sexual misconduct policies and processes. Collaborate with on‑and off‑campus resources including law enforcement and victim services, and work with other investigators to ensure that the University’s processes, responses, and policies are consistent with federal and state laws and regulations related to compliance with nondiscrimination laws. Manages special projects and assists in overflow duties, as assigned. QUALIFICATIONS To perform this job successfully, an individual must be able to perform each essential duty satisfactorily. Knowledge Working knowledge of nondiscrimination laws and compliance regulations including Title IX, due process protections as they apply to student and employee conduct proceedings, e.g., Title IX, Title VI, Title VII, Section 504 of the Rehabilitation Act, the ADA, the FMLA, VAWA, and FERPA. Knowledge of investigation techniques and best practices, community engagement strategy, and approaches to systemic reform. Skills Specialized experience and knowledge and demonstrated skill in party and witness examination/interview and investigation techniques, including leading effective party and witness interviews; assessing witness credibility and identifying inconsistencies in information; and producing high quality written work products. Use of tact and diplomacy in interviewing and communicating with individuals from diverse backgrounds while remaining calm and impartial during sensitive, confrontational, and stressful situations. Conduct interviews and other communications from a trauma‑informed approach. Superb written and verbal communication skills and strong public speaking and presentation skills. Uses thought provoking content and delivery style to make an impact and gain commitment from stakeholders. Strong work ethic and attention to detail: Highly motivated, self‑directed execution of routine and special projects. Strong interpersonal skills and emotional intelligence: Demonstrated ability to function well in both leader and teammate roles and interact with colleagues and superiors in a positive and constructive manner when faced with significant deadlines or workloads. Proficiency with PCs, especially word processing, spreadsheets, database, and presentation software are essential (preferably Microsoft Word, Excel, and PowerPoint). Ability to analyze complex policies, rules, laws, reports, medical records and other pertinent documents. Can effectively communicate complex data analyses, difficult information, and methodology and implications to managers or other staff. Excellent planning, organizational, and time‑management skills are essential. Creative problem‑solving skills are essential. Ability to deal with a wide variety of staff, students, and faculty. Team oriented individual with willingness to take initiative and get things done. Strength of character, honesty, and integrity; maintaining neutrality, impartiality, objectivity, and high ethical standards in each case. Abilities Expertise in applicable policies, principles, and processes. Demonstrated ability to independently and efficiently manage a significant caseload. Ability to work weekends and evenings (when necessary) and some limited travel. Demonstrated ability to multi‑task and manage a volume‑oriented caseload with close attention to detail. Exhibit the ability to build effective working/networking relationships with on and off‑campus partners, state/federal civil rights agencies, and relevant professional associations. Demonstrated ability to work proactively and independently and exercise high‑level discretion and good judgment, and ability to quickly establish credibility with a broad range of constituents, including executives, administration, faculty, staff, student groups, and students. Ability to maintain data integrity and information confidentiality in dealings with sensitive documents and with faculty or staff personal issues. Ability to multitask, prioritize, adapt, make necessary adjustments, and meet deadlines. Ability to effectively establish and maintain cooperative working relationships. Ability to communicate with stakeholders with diverse backgrounds and experience, including experience with trauma. Work flexible hours as necessary. Education Bachelor’s degree required. Advanced degree in law, psychology, social work, public policy, public health, education, criminology, or other related fields preferred. Experience Required Qualifications 6-8 years of investigation experience, with particular focus on Title IX, sexual assault, sexual misconduct, civil rights, or similar discrimination complaints, or equivalent experience. At least two years of experience preparing comprehensive investigation reports that includes in‑depth analyses. At least two years of experience working in an on‑campus position, either in K‑12 or higher education. A writing sample will be requested from those under consideration. Preferred Qualifications Experience in conflict management Completion of training in investigation techniques Completion of training in Title IX and/or Title VII and/or Civil Rights Investigations, trauma and in sexual assault investigations Completion of training in mediation, restorative practices and/or alternative resolution Significant prior experience working collaboratively with victims, victim rights advocates, law enforcement officials, and/or other key stakeholders.
