Qualifications J.D with minimum additional experience of 20 year(s) in legal work regarding CERCLA, the National Contingency Plan (NCP), Clean Water Act (CWA), National Environmental Policy Act (NEPA), National Historic Preservation Act (NHPA), Occupational Safety and Health Administration (OSHA) (29CFR1910.120), Environmental Protection Agency (EPA) regulations, Toxic Substances Control Act (TSCA), Resource Conservation and Recovery Act (RCRA). Professional expert level knowledge of CERCLA, RCRA, CWA, NEPA, TSCA, NCP, ECRB/CSP, OSHA (29CFR1910.120), and related EPA regulations and NPS, Federal, and State guidelines and laws. Mastery of, and skill in applying, legal expertise in advanced theories, principles, concepts, standards, and methods of CERCLA cost recovery/enforcement in order to develop new approaches and solutions to contaminant site related problems and issues involving a combination of complex features; provide expert legal advice to senior managers responsible for program operations; provide significant and innovative recommendations; and execute significant contaminated site cost recovery/enforcement affecting the welfare of the public and the sustainability of natural resources in national parks. Experience required with Windows, MS Word, MS Excel, MS Teams, MS Outlook, MS SharePoint, Adobe Acrobat Duties Enrollee ensures that all response activities are consistent with, but not limited to: CERCLA, the National Contingency Plan (NCP), WASO Environmental Management Programs Branch (EMPB), Clean Water Act (CWA), National Environmental Policy Act (NEPA), National Historic Preservation Act (NHPA), Occupational Safety and Health Administration (OSHA) (29CFR1910.120), Environmental Protection Agency (EPA) regulations, Toxic Substances Control Act (TSCA), Resource Conservation and Recovery Act (RCRA), NPS, Federal, and State policies, guidelines, and laws, and other applicable laws and regulations. Legal Research - Ensures that all program activities are consistent with CERCLA, NCP, and NPS CERCLA precedents and policies service-wide, and ongoing enforcement efforts by coordinating all CERCLA activities, including document review, with oversight by the Regional Environmental Coordinator (REC) and EMPB as appropriate. Researches and drafts dispositive motions for client and senior attorney review. Prepares and executes extensive information gathering, including the preparation of CERCLA Section 104 requests. Prepares and handles legal document review and the litigation process for assigned cases. Conducts extensive legal research of complex and difficult legal questions and prepares all potential legal arguments in connection with cases. Performs factual and legal research to support litigation and transactional matters. Reviews all documents to determine whether they are accurate and meet DOI/NPS requirements. Conducts investigations of limited scope to obtain facts, study legal precedents, and prepare recommendations for review of client and senior attorney.60% Prepares and Evaluates Legal Documents - Prepares clear, concise and well-written legal opinions and memoranda for review and issuance by the assigned governmental official(s). Reviews statutes, regulations and case law in order to provide legal opinions on a variety of matters. Compiles accurate and timely weekly reports as requested. Prepares and reviews Departmental issuances and program forms, legal documents and forms, issuances, such as Handbooks, Notices, and supplement program regulations and provides the detailed instructions and procedures necessary for effective, regional nationwide implementation of program statutes and regulations. Prepares memoranda and reports outlining and analyzing the factual and legal issues involved, explaining the application of legal principles and precedents, and justifying recommendations or conclusions.40% Other Overnight travel: Occasional travel to a PWR Regional Office (Seattle, WA or San Francisco, CA) of approximately one week may be required Air travel anticipated: Depending on enrollee location, air travel may be occasionally required Physical requirements: Position is primarily sedentary and performed in an office environment.
