This position is listed on behalf of a partner company, who manages all applications and next steps. Our partner is looking for a Counsel, IP Litigation & Enforcement based in United States.
This is a globally scoped legal role supporting intellectual property investigations, enforcement, litigation, and compliance response activities.
You will serve as a key legal resource for teams handling complex IP matters across multiple jurisdictions and legal systems.
The role combines legal analysis, investigations, litigation support, regulatory guidance, and strategic risk management.
You will work closely with investigators, clients, outside counsel, law enforcement agencies, regulators, and internal operational teams.
Success requires strong judgment, exceptional organization, and the ability to translate complex legal issues into practical guidance for non-lawyers.
The position offers significant ownership, exposure to senior leadership, and the opportunity to shape legal standards and processes within a fast-growing global environment.
It is particularly well suited to a self-directed lawyer who thrives on varied, high-volume matters and cross-border collaboration.
Accountabilities
- Serve as the primary day-to-day legal resource for IP investigation and enforcement teams operating across online and offline environments.
- Establish and maintain legal standards, decision criteria, escalation thresholds, written guidance, and training materials for investigations and enforcement activities across jurisdictions.
- Advise on evidence sufficiency, collection methods, documentation, preservation, and chain-of-custody requirements to ensure evidence can withstand scrutiny in civil, criminal, administrative, and customs proceedings.
- Identify jurisdiction-specific legal considerations, coordinate with local counsel when needed, and escalate significant legal, regulatory, or reputational risks with clear recommendations.
- Assess matters for escalation to civil litigation, criminal referrals, private prosecution where available, and administrative or customs action.
- Support clients and their external counsel throughout civil IP litigation, including pre-suit assessments, pleadings and submissions, discovery, disclosure, and matters involving employees or affiliates as expert witnesses.
- Prepare and support criminal referral packages for law enforcement and prosecuting authorities, including factual chronologies, legal theories, loss assessments, and evidentiary indexes.
- Coordinate with law enforcement, prosecutors, customs and border agencies, regulators, and platform partners on legal and evidentiary matters.
- Advise on cross-border evidence gathering, third-party disclosure mechanisms, and other legal tools relevant to investigations and enforcement.
- Track escalated matters through resolution while managing external counsel expectations around scope, budgets, timelines, and outcomes.
- Act as the primary legal liaison for revenue recovery activities, advising on evidence, claims, limitation periods, jurisdiction, governing law, collectability, and legal sufficiency.
- Provide legal oversight for compliance-response matters involving emergency disclosure requests, subpoenas, search warrants, court orders, exigent requests, and other legal notices.
- Review ambiguous, novel, or potentially non-compliant requests and advise on validity, scope, jurisdiction, preservation, disclosure, and rejection decisions.
- Ensure investigative and enforcement activities comply with applicable law and internal standards, including requirements related to evidence handling, online monitoring, test purchases, third-party interactions, investigator licensing, and personal data.
- Monitor compliance across global operations, investigate deviations, support remediation, and deliver legal education and practical guidance to relevant teams.
- Maintain playbooks, templates, escalation pathways, and knowledge resources that support consistent legal decision-making and service-level commitments.
Requirements
- Qualified lawyer in good standing and admitted or otherwise authorized to practice in a United States jurisdiction, the United Kingdom, or an EU member state.
- 3–5 years of post-qualification experience gained in private practice, an in-house legal department, government agency, prosecuting authority, or comparable legal environment.
- Based in the United States or United Kingdom with unrestricted authorization to work in the relevant country.
- Demonstrated ability to manage a high volume of concurrent legal matters while maintaining exceptional attention to detail and meeting demanding deadlines across time zones.
- Excellent written and verbal English communication skills, with the ability to translate complex legal concepts into clear, practical guidance for investigators, operations teams, and clients.
- Strong judgment and independent decision-making skills, including the ability to prioritize work, drive matters to completion, and make defensible recommendations when information is incomplete.
- High level of discretion when handling confidential, privileged, sensitive, or investigation-related information.
- Substantive experience in IP enforcement, particularly anti-counterfeiting, anti-piracy, trademark or copyright enforcement, digital or marketplace takedowns, illicit trade, or brand protection, is highly desirable.
- Experience working with law enforcement agencies or prosecutors, including criminal referrals, is preferred.
- Previous experience in a prosecutorial, police, customs, regulatory agency, or task-force environment is advantageous.
- Experience working in a fast-paced, multi-jurisdictional professional services environment is preferred.
- Additional language skills beyond English are a plus.
Benefits
- US salary: $110,000–$140,000 USD annually, depending on experience and qualifications, plus bonus.
- UK salary: £70,000–£90,000 GBP annually, depending on experience and qualifications, plus bonus.
