While the position is based in our New Orleans office, we welcome applicants from across the United States and are open to hires reporting to other regional offices if located elsewhere.This is a fully remote position.The PositionThis is a excellent opportunity for cybersecurity attorneys who are eager to advance their careers and take on significant, substantive responsibilities in defending complex cybersecurity-related cases.Key Responsibilities:Incident response for cybersecurity and data privacy incidentsTaking lead responsibility in responding to clients and carriers, and overseeing breach response work by AssociatesInteraction with senior level management and technical personnel at client companiesAnalysis of state, federal, and international privacy lawsDrafting legal notices of a data breach to individuals and regulatorsResponding to regulatory investigations arising out of a data breachDefending privacy lawsuitsDrafting privacy and security policies and procedures pursuant to HIPAA, GLBA, CCPA, and other statutesTriaging data breaches/incident responseAdvising clients on handling cybersecurity incident from start to finishOversight of forensics investigationsOversight of third party vendors for e-Discovery, data mining, and notice projectsAdvising clients on legal notification obligations under State/Federal lawsDrafting breach notification letters to individuals and State/Federal RegulatorsDrafting Crisis Communications for clientsResponding to inquiries and investigations by State/Federal RegulatorsInterfacing with clientsDrafting reports to insurance carriers and clientsPreparing legal budgetsSupervising junior team membersQualificationsJD from an accredited Law School is requiredMust be admitted to Bar in good standing8+ years legal experience5+ years of experience in data privacy and security, with particular focus on data breach and incident responseStrong knowledge of data breach and privacy laws (HIPAA, GLBA, FERPA, CCPA, GDPR, etc.)IT or technical background a plusSome litigation experience is a plusExcellent research, writing, and communication skills (Lexis and Westlaw)Ability to work in a fast-paced environmentTeam playerWilson Elser offers a competitive salary and benefits package designed to support our attorneys both professionally and personally.A variety of factors are considered in making compensation decisions, including but not limited to experience, education, licensure and/or certifications, geographic location, market demands, other business and organizational needs, and other factors permitted by law. This position is also eligible for discretionary bonuses. Final salary wages offered may be outside of this range based on other reasons and individual circumstances. This position is considered full-time and therefore qualifies for benefits including 401(k) retirement savings plan, medical, dental, vision, disability, and life insurance. Details of participation in these benefit plans will be provided if an employee receives an offer of employment.
