Attorney/Attorney III - Enforcement Division - Hybrid Option

Responsibilities Under the general direction of the Assistant Chief Counsel of the California Privacy Protection Agency (CalPrivacy) and occasional instruction from the Deputy Director of the Agency’s Enforcement Division, the Attorney III is responsible for prosecuting violations of the statutes and regulations under CalPrivacy’s Enforcement Division in administrative enforcement actions. The attorney investigates violations, reviews consumer complaints and other leads, gathers and analyzes facts, evaluates legal arguments and defenses, conducts probable‑cause hearings, drafts administrative pleadings, and presents legal arguments before probable‑cause hearing officers, administrative law judges, and the CalPrivacy Board. The attorney participates in all aspects of administrative enforcement actions including discovery, motion practice, and settlement discussions with opposing counsel. Telework is available for this position; however, changes to the telework program are at the agency’s discretion. Remote‑centered employees may be required to report in person to one of the agency’s multiple reporting locations, as determined by management, and may be required to utilize a shared workspace or “hotel” when working in the office. The Attorney III collaborates with the Enforcement Division’s Attorney IV, who may serve as lead counsel on joint projects, and with the California Attorney General’s office and other government agencies in other jurisdictions. Qualifications Experience of post‑JD litigation of administrative cases with responsibility for all aspects of discovery, trial, settlement negotiations, and appeals; or pre‑JD coursework covering administrative litigation. Experience advising a government agency or other organization and developing subject‑matter expertise in a variety of complex subjects. Experience in matters involving government investigations, partnering with law enforcement, gathering evidence, issuing subpoenas, and making enforcement recommendations. Experience in matters involving responding to government investigations or conducting corporate internal investigations. Strong ability to analyze complex legal and factual issues, write clearly and persuasively, and exercise fair and sound judgment. Experience reviewing contracts, including memorandums of understanding, and inter‑agency agreements. Experience with privacy, data security, and technology policies. Experience with a high volume of work with minimal supervision. Excellent written and oral communication skills. Strong organizational and analytical skills.
