Position Summary
The primary function of an employee in this class is to perform advanced professional legal and administrative work involving civil litigation, including claims against the County. This position also provides legal counsel to County officials, managers, and departments. The position will also work on issues related to asset forfeiture, contracts / agreements, post-conviction restitution, and personnel. The work is performed under the general supervision of the County Prosecutor and Chief Deputy Prosecuting Attorney, but considerable latitude is granted for the exercise of independent judgment and initiative. The principal duties of this class are performed in a general office and courtroom environment.
Essential Duties and Responsibilities (will vary by assignment)
- Performs all duties and responsibilities with professional decorum and in accordance with County policies, procedures, and safety practices,
- Prepares and manages civil cases for trial, including but not limited to, responding to complaints and claims, conducting research, interviewing affected parties, preparing required legal and court documents, preparing, and arguing briefs, and attending court proceedings,
- Conducts necessary legal research to accurately respond to inquiries concerning civil matters from County elected appointed officials, managers, and departments of the County,
- Provides legal counsel and advice to elected and appointed County officials, managers, and departments,
- Conducts research of legal precedents, federal laws, state statutes, and County ordinances and represents the County's interest in court,
- Drafts, revises and maintains ordinance language as required,
- Reviews, tracks, advises, and investigates as necessary, torts submitted to the County or escalated personnel matters,
- Negotiates case settlements, and is responsible for post-conviction restitution civil assets and restitution,
- Advises on general communications to the public related to legal matters affecting the County,
- When requested, attends Board of Commissioner meetings, contract meetings, hearings, or other meetings on behalf of the Prosecutor or Chief Deputy Prosecuting Attorney,
- Assists as needed or where requested with some criminal, juvenile or other case load assignments according to the needs of the Prosecutor or department,
- May share on-call responsibilities after regular hours to respond to emergency situations, and
- Performs all other required duties or undertakes actions related to the responsibilities of the position to meet County or departmental objectives.

The position obtains, possesses, and deploys the following knowledge, skills, and abilities to effectively perform their responsibilities:
Knowledge Of:
- Legal, court, civil and judicial proceedings, rules, terminology, methods, documents, practices, and objectives typically used in a courtroom environment,
- Applicable federal, state, and municipal laws, statutes, ordinances, and code needed for practice of the assigned caseload and duties, and their application to county government, and
- Legal research methods and applications used to determine established precedents and sources of legal references applicable to the County caseload and current legal issues.
Skill To:
- Analyze evidence, organize facts, identify precedents, weigh alternatives, and anticipate possible to develop and deploy an appropriate legal strategy and logical argument(s),
- Appear without assistance in court and other judicial proceedings and be able to present evidence, arguments, testimony, and witnesses before a judge or jury,
- Negotiate complex legal issues with opponents, and bring interested and affected parties to consensus,
- Operate standard office equipment, including a personal computer, printer/scanner, and job-related software applications, and,
- Make significant/substantial legal decisions in individual cases based on a combination of factors including the law, policy, and rules of ethics.
Ability To:
- Communicate effectively, both orally and in writing, for purposes of advocating, persuading, negotiating, and counseling for or on behalf of the County,
- Maintain a professional demeanor during all situations, and maintain effective working relationships with other County employees, staff, attorneys, law enforcement personnel, victims, witnesses, supervisory personnel, agency stakeholders, state and local elected and appointed officials, and the public, and
- Perform a wide variety of duties and responsibilities with accuracy and speed under the pressure to meet time-sensitive deadlines, and be able to perform multiple tasks simultaneously, manage case priorities, including handling interruption and change, and
- Demonstrate character, integrity, and ingenuity in representing the County.
Minimum Requirements
- Graduation from a school of law accredited by the American Bar Association with a Juris Doctorate Degree (JD),
- Admission to the Idaho State Bar with an active license to practice law in the State of Idaho and maintain such membership in good standing, and
- Six (6) years of litigation experience.
Preferred Requirements
- Preference given to those with extensive jury trial experience, and
- Preference given to those with County, City or civil litigation experience.

- Sufficient clarity of speech and hearing or other communication capabilities, with or without reasonable accommodation, which permits the employee to discern verbal instructions and to communicate effectively in person, on a telephone, and in a courtroom environment,
- Sufficient manual dexterity, with or without reasonable accommodation, which permits the employee to operate standard office equipment and a personal computer,
- Sufficient visual and sensory acuity, with or without reasonable accommodation, which permits the employee to comprehend written work instructions and to assist in the preparation, monitoring, and litigation of all criminal and civil cases, and
- Sufficient personal mobility, flexibility, and balance, with or without reasonable accommodation, which permits the employee to work in an office environment, lift up to 20 pounds, and perform in a courtroom environment.
