Attorney, Health & Human Services Division: Litigation

State of West Virginia

Assistant Attorney General, DoHS Six positions available. The Office of the West Virginia Attorney General is seeking multiple attorneys to represent the WV Department of Health Services (DoHS) in various locations throughout the state. The attorney will represent DoHS in litigation and appeals before state and federal courts and administrative agencies. Attorneys in these positions will also play a vital role in developing better working relationships among the many key players in abuse and neglect proceedings. These attorneys will be the relationship partners or liaisons between the DoHS and Prosecuting Attorneys who represent the DoHS in civil abuse and neglect cases. They will also assist the DoHS in helping facilitate the timely exchange of information and documentation with counsel representing other parties in the cases, as well as with the judges presiding over the matters, so the courts can move the litigation forward as efficiently as possible for all those involved. These attorneys will provide advice to the client, the DoHS, on litigation strategies and day‑to‑day operations, assist with policy development and implementation, and engage with other state and federal agencies on the client’s behalf. Qualifications: Active West Virginia license or eligibility for admission. Strong work ethic and genuine desire to effect transformational change in child welfare system. Assistant Solicitor General The West Virginia Attorney General's Office is accepting applications from attorneys interested in serving as an Assistant Solicitor General. This unique opportunity offers attorneys a chance to work on matters of exceptional complexity and importance to the State. Responsibilities include managing all appellate work in the Office, drafting appellate briefs, dispositive motions, administrative comments, writing Attorney General Opinions, coordinating multistate efforts, managing day‑to‑day litigation matters, researching, analyzing, consulting on matters of importance, and providing oral argument opportunities. The group works on both civil and criminal matters across all practice areas and on statewide and national cases involving federalism, constitutional matters of first impression, and other significant issues for the State. Qualifications: At least four years of professional experience and excellent writing skills. Clerkship or prior experience in appellate litigation is particularly beneficial. Assistant Attorney General, Consumer Protection The West Virginia Attorney General’s Office seeks attorneys for its Consumer Protection & Antitrust Division. This division protects consumers through enforcement of the WVCCPA, the WV Antitrust Act, and related laws. Attorneys work with consumers and companies to resolve complaints, conduct investigations of business practices, and file civil suits on behalf of the State for violations of consumer protection or antitrust laws. Responsibilities: Manage own caseload and collaborate within the office on multistate investigations or litigations. Qualifications: Strong written and oral communication skills. Electronic discovery knowledge and negotiation experience. Background in consumer protection and/or antitrust is a plus; general litigation or prosecutorial experience also acceptable. Commitment to public service. Active West Virginia license or eligibility for admission. Bankruptcy Attorney The West Virginia Attorney General’s Office seeks an attorney to join the Tax & Revenue, Legislative Claims Commission and Transportation Division. Ideal candidates will have at least three (4) years’ experience in bankruptcy law, preferably on the creditor side. Responsibilities: Provide expert legal counsel and representation to state agency clients seeking to collect judgments, tax liabilities, and other claims from entities that have entered bankruptcy. Assist state agency clients in understanding their rights and obligations in bankruptcy proceedings. Prepare and file necessary legal documents to preserve priority of state agency claims and liens. Represent state agency clients in bankruptcy hearings, negotiations, and court proceedings. Communicate effectively with state agency clients, debtors’ counsels, trustees, and other parties involved in bankruptcy cases. Stay abreast of changes and developments in bankruptcy law and procedure. Qualifications: At least four years’ experience in bankruptcy or creditor side. Litigation experience, excellent academic and professional credentials. Superior oral and written communication skills; outstanding legal research, analytical, and reasoning skills. Ability to function with minimal guidance in a demanding legal environment. Active West Virginia law license or eligibility for admission. Senior Assistant Attorney General, Consumer Protection The West Virginia Attorney General’s Office seeks a senior management attorney for its Consumer Protection & Antitrust Division. Responsibilities: Manage attorneys and staff, supervise administrative functions, use time management software, maintain employee records, and handle day‑to‑day operations. Handle high‑profile, complex, and multi‑state litigation. Qualifications: Active West Virginia law license or eligibility for admission. At least eight years of senior management experience managing attorneys and staff. Experience handling high‑profile, complex, multi‑state litigation. Assistant Attorney General, Arts & Education Division The Office of the West Virginia Attorney General is seeking a full‑time attorney to join its Arts & Education Division to represent various state agencies as required. Ideal candidates will have a minimum of five years of litigation experience. This position is responsible for litigation primarily in administrative forums and state circuit courts, as well as appellate work before the West Virginia Intermediate Court of Appeals and Supreme Court of Appeals of West Virginia. Responsibilities: Litigation representation and providing general counsel and advice to multiple client agencies as assigned. Qualifications: Strong written and oral advocacy skills. Comfortable practicing independently with limited clerical support. Knowledge or experience representing government agencies is preferred. Active West Virginia law license. Assistant Attorney General, Arts & Education Division – Office of Miner’s Health, Safety, and Training The Office of the West Virginia Attorney General is seeking a full‑time attorney to join its Arts & Education Division to represent the Office of Miner’s Health, Safety, and Training (“OMHST”). Ideal candidates will have a minimum of five years of litigation experience. Responsibilities: Litigation representation and providing general counsel and advice to OMHST. Qualifications: Strong written and oral advocacy skills. Experience representing government agencies or with coal mining regulations is preferred. Active West Virginia law license. Assistant Attorney General, Civil Rights The Office of the West Virginia Attorney General is seeking a full‑time attorney to handle civil rights matters, such as employment and housing discrimination claims. The position will include legal representation of the WV Human Rights Commission in discrimination cases; other types of litigation in administrative forums, trial courts, and appellate courts is likely. Responsibilities: Represent the WV Human Rights Commission in discrimination cases and other civil rights litigation. Qualifications: Minimum five years of litigation experience, including experience before the WV Human Rights Commission preferred. Strong interpersonal and organizational skills, written and oral advocacy skills. Active West Virginia law license. Commitment to training and mentoring attorneys as needed. Assistant Attorney General, Health and Human Services Division The West Virginia Attorney General’s Office seeks a full‑time attorney to represent state agencies in the Health and Human Services Division in the Eastern Panhandle. Candidates will primarily be responsible for litigating matters in federal, state, and administrative courts, researching and drafting briefs, writs, and motions before the West Virginia Supreme Court of Appeals and Intermediate Court of Appeals.
