Cancellation Policy: MINIMUM GUARANTEE. For contract Personnel confirmed for eight (8), ten (10) or any combination of eight (8), ten (10) and twelve (12) hour shifts, Client will provide Personnel a minimum of eighty (80) scheduled hours bi-weekly. For contract Personnel confirmed for twelve (12) hour shifts, Client will provide Personnel a minimum of seventy-two (72) scheduled hours bi-weekly. These guaranteed hours do not include any "on-call" time worked by travel Personnel. Client reserves the right to float or reassign Personnel to other areas of practice within their clinical competence to fulfill the guaranteed hours and within ten (10) miles of their originally assigned facility. 12 hour shift = 48 hours can be called off for low census per 13 week assignment ? 10 hour shift = 40 hours can be called off for low census per 13 week assignment? 8 hour shift = 32 hours can be called off for low census per 13 week assignment No perm fee after 26 weeks completion. CANCELLATION OF SHIFT. Client may change or cancel its request for daily Personnel (for low census or otherwise) provided Agency is notified at least two (2) hours prior to the start of a shift. If less than two (2) hours' notice is provided, Agency will charge Client two (2) hours at the designated shift and daily Personnel's hourly rate. For cancelled shifts greater than four (4) per Personnel that are called off or cancelled, Agency will pay the contracted rate per hour for the full shift called off or cancelled ("Shift Cancellation Penalty"). Client shall not pay Agency for any shift called off or cancelled by Personnel. To the extent Member has already paid the fees associated with such shift, Agency shall reimburse Member the full amount paid by Client at the hourly contracted rate for the entire shift. CANCELLATION OF ASSIGNMENT WITHOUT CAUSE. i. At any time prior to the start-date of an Assignment, Client may terminate a Confirmed Order for a travel Personnel without cause by providing written notice to Agency. In such Instance, neither the biweekly Minimum Hours Commitment nor the Shift Cancellation Penalty shall apply. Notwithstanding the above, in the event a cancellation prior to the start days occurs with less than a two (2) week advance notice from the start date, Client shall pay all non-refundable travel and lodging costs associated with such assignment. At any time after the start-date of an Assignment, Client may terminate such Assignment for a Travel Personnel without cause by providing written notice to Agency with a two (2) week advance written notice. At such time, at the discretion of Client, Client may elect to continue such Personnel for the remaining two (2) week time period or pay Agency a penalty equal to 72 hours of such individuals
