Litigation Attorney

We are looking for a driven, goal-oriented Collection Litigation Attorney who wants to work hard, develop their legal expertise, and build meaningful opportunities for long-term professional growth.

About the Role

The Collection Litigation Attorney will manage matters involving delinquent accounts, collections, and secured debts, including matters that may ultimately proceed to litigation and foreclosure.

A critical part of this position is direct communication with debtors. You will speak with individuals regarding past-due balances, payment obligations, potential resolutions, and the consequences of failing to resolve the matter.

These conversations will not always be easy. Debtors may be angry, frustrated, emotional, or financially distressed. The right attorney must be comfortable having these conversations directly, professionally, and confidently.

The objective is to pursue appropriate resolutions whenever possible. However, when a matter cannot be resolved, the attorney must be prepared to move the matter into litigation and manage the case through the legal process, which may ultimately result in foreclosure of the property securing the debt.

Responsibilities

Collections & Pre-Litigation

·         Manage a portfolio of delinquent and potentially litigated accounts.

·         Communicate directly with debtors regarding past-due balances and available resolution options.

·         Have difficult conversations with debtors who may be upset, angry, or resistant to payment.

·         Clearly explain the status of an account and the potential legal consequences of failing to resolve the delinquency.

·         Negotiate payment arrangements, settlements, and other appropriate resolutions within established authority.

·         Evaluate matters for litigation and determine appropriate next steps.

·         Conduct legal and factual analysis of claims, defenses, documentation, and potential recovery.

·         Work closely with clients and internal team members to evaluate and resolve delinquent accounts.

·         Maintain consistent follow-up and actively move matters toward resolution.

·         Document communications, negotiations, and material developments accurately.

Litigation

·         Manage collections litigation from initial filing through judgment and post-judgment proceedings.

·         Draft and review complaints, motions, pleadings, discovery, correspondence, and other legal documents.

·         Develop litigation strategies based on the facts, applicable law, documentation, and available remedies.

·         Handle discovery, including drafting and responding to discovery requests and managing discovery disputes.

·         Take and defend depositions as appropriate.

·         Appear at hearings, mediations, conferences, and other court proceedings.

·         Communicate with opposing counsel and parties to negotiate resolutions and advance litigation.

·         Prepare cases for trial, including witness preparation, exhibits, evidence, and trial strategy.

·         Evaluate settlement opportunities while protecting the client's interests.

·         Manage litigation deadlines and ensure matters progress efficiently.

·         Pursue judgments and appropriate post-judgment remedies.

·         Manage matters through the foreclosure process when resolution cannot otherwise be achieved.
