Job Details Job Title: Assistant Vice President, Associate General Counsel Agency: Construction & Development Department/Division: Contracts\Construction Contracts Reports To: Vice President, Associate General Counsel Work Location: 2 Broadway Hours of Work: 8:30 AM to 5:00 PM or as required (7.5 HR/ DAY) Grade: 007 Salary Range: $143,713 to $179,641 Telework: Eligible, one day per week Overview This position is a senior officer of MTA Construction & Development, reporting to the Vice President of the General Counsel & Contracts Department. The Associate General Counsel provides legal advice and leads rapid‑response contracting services to the C&D departments, recommending the best contracting strategy for a given project, managing the procurement process, and realizing the full benefits of those contracts after award. As a Business Unit co‑lead, the incumbent will lead these activities for at least one category of capital projects—Stations, Signals & Train Control, Infrastructure, Bridges & Tunnels, Railroads, or Consulting Contracts—and may also oversee one or more large, integrated projects that span multiple categories. Responsibilities Responsible for all contracts within the business unit, from strategy to drafting, soliciting and procuring, negotiating and awarding, and claims and change management. Develops strategic and consistent contracts and specifications to reduce risk to budget and schedule, optimizing risk allocation to achieve lower contract prices. Provides contracting‑strategy advice well in advance of the formal procurement process. Collaborates with Development to create contracts that address market capacity, procurement, contracting timelines, strategies, and federal versus state funding issues. Collaborates with C&D engineers and PCEOs to understand vision and draft contracts that are cogent, enforceable, and deliver desired project benefits. Helps increase the utilization of MWBE vendors in all contracts. Advises delivery‑department leaders on contract enforcement, claims management, merit determinations, and prosecuting or defending claims as necessary. Understands, drafts, and manages innovative construction contracts such as A+B bidding, design‑build, progressive‑design build, and other state‑of‑the‑art methods to support the MTA’s Capital Programs. Enforces all applicable laws, regulations, and the MTA’s public works contracting policies, as well as funding‑partner requirements such as the Federal Transit Administration. Manages a staff of 12‑23, analyzes complex construction issues, represents the agency in disputes, negotiates significant contracts and/or claims, and collaborates with FTA and FRA counsel as needed. Qualifications Juris Doctor and admission to the New York State Bar Association. Excellent academic credentials. Minimum of five (8) years of progressively independent legal experience in a law firm, governmental legal office, or in‑house department. Experience with complex public‑works projects, construction and/or real‑estate matters, and familiarity with local, state, and federal laws. Experience with federal and state procurement laws, rules, and regulations. Strong initiative, judgment, and ability to work independently on matters of significant size and complexity. Ability to manage multiple projects and clients in a fast‑paced environment. Confidence in dealing with senior management and sophisticated counterparties. Creative, business‑oriented solutions to legal and business risks. Strong interpersonal, analytical, problem‑solving, organization, drafting, negotiation, and communication skills. Proven capability to build and maintain strong client relationships. Engineering or construction‑management experience preferred.
