The Opportunity:
Revolution Medicines is seeking a highly experienced healthcare and commercial attorney to serve as Associate Director, Healthcare Law. Reporting to the Executive Director, Healthcare Law, this role will serve as a recognized subject-matter expert and [lead] legal partner for commercialization activities, supporting the Commercial function and other cross-functional stakeholders. Working collaboratively within the Legal department, this role will lead the commercial market access contracting discipline for assigned products and programs, drive legal strategy and policy development, inform decision-making at the Director and senior leadership levels, and advise on related legal, business, regulatory, and compliance considerations with medium- to long-term business impact.
Responsibilities:
-
Serve as lead legal parter to Market Access on the drafting, negotiation, and management of wholesaler/distributor, specialty pharmacy, 3PL, GPO, PBM/payer, managed care, rebate, government, and value-based contracting arrangements supporting product launch and distribution, and establish contract templates, playbooks, and negotiation positions for the discipline.
-
Provide strategic legal advice related to patient support programs, patient hubs, copay and patient assistance programs, independent charitable foundation interactions, market access, pricing, reimbursement, and distribution via different channels and interest groups (e.g., specialty distributors, specialty pharmacies, PBMs, GPOs, 340B covered entities).
-
Advise on government pricing and price reporting obligations, including the Medicaid Drug Rebate Program (AMP and Best Price), 340B Drug Pricing Program, Medicare Part B ASP reporting, VA/FSS and Public Health Service pricing, Medicare Part D and Inflation Reduction Act requirements, and state drug price transparency laws, in partnership with Government Pricing and Finance.
-
Serve as legal partner to Commercial, Market Access, Marketing, Medical Affairs, and Patient Services teams, providing strategic legal guidance and contractual support for the company’s planned commercialization and launch activities.
-
Serve as subject-matter expert on healthcare regulatory law, including the FDCA and related regulations and guidance documents; fraud and abuse laws and guidance (Anti-Kickback Statute and its safe harbors, False Claims Act, Civil Monetary Penalties Law, OIG Compliance Program Guidance and Advisory Opinions); and federal and state transparency and reporting laws.
-
Partner with the Compliance sub-function to develop, implement, and operationalize policies, procedures, training, and monitoring for commercialization activities, and provide input on enterprise compliance strategy beyond the Legal discipline.
-
Review and advise on promotional, advertising, and non-promotional materials and activities as the Legal representative on promotional review committees, including speaker programs, digital and social media campaigns, scientific exchange, and payer and formulary communications.
-
Counsel on healthcare professional (HCP) and healthcare organization engagement, including consulting and advisory board arrangements, fair market value, speaker programs, grants and sponsorships, meals and interactions, and Open Payments (Sunshine Act) and state transparency reporting.
-
Advise on health information privacy and data governance matters relevant to commercialization, including HIPAA, state consumer health data and privacy laws, patient data use in hub and support programs, and data licensing and analytics arrangements, in coordination with Privacy and IT.
-
Monitor and assess legislative, regulatory, and enforcement developments (e.g., DOJ, OIG, FDA, CMS, and state attorneys general), translate them into practical guidance and discipline plans, and proactively advise senior leadership on emerging risks.
-
Regularly collaborate with and influence senior management and executive leadership on matters of significance to the discipline, negotiate with external counterparties, and manage outside counsel, including budgets and scope of work.
-
Lead cross-functional legal and change initiatives for the discipline, and may manage, mentor, and develop attorneys, contract managers, or paralegals, fostering a values-driven culture of collaboration, integrity, and accountability.
