About the Practice

James H. Bartolomei III, P.A. (Of Counsel, Duncan Firm, P.A.) maintains an active federal copyright litigation practice representing photographers, filmmmakers, authors, and other rights holders. Cases are currently pending in the Central District of California, Northern District of California, Southern and Eastern Districts of New York, and federal courts in Florida, the District of Columbia, Texas, and Colorado, with additional matters in AAA arbitration. The work spans individual infringement actions, multi-plaintiff matters, DMCA and CMI claims under 17 U.S.C. § 1202, and statutory damages litigation under § 504. The firm also handles selected labor and business disputes.

The Role

I’m hiring a litigation paralegal to own day-to-day case management across this docket. This is a substantive seat — not a filing clerk role. You’ll work directly with me on cases that involve significant registered works, sophisticated opposing counsel, and real damages exposure. I prepare each case for trial.

What You’ll Do

• Run discovery on copyright matters — drafting and responding to interrogatories, RFPs, and RFAs; coordinating productions; preparing 30(b)(6) notices and deposition outlines.

• Manage federal court filings via PACER/ECF across multiple districts, with particular attention to CDCA local rules and standing orders.

• Build and maintain case files involving copyright registrations, deposit copies, DMCA notices, CMI evidence, and chain-of-title documentation.

• Support motion practice — discovery motions, spoliation and sanctions, sunmary judgment, evidentiary motions, and dispositive motions — including cite-checking, exhibit preparation, and tables of authorities.

• Manage AAA arbitration filings, procedural orders, and compliance deadlines.

• Handle settlement and post-judgment documentation.

• Track deadlines across a multi-jurisdiction docket where missed dates have real consequences.

• Prepare exhibits for trial

What I’m Looking For

• 5+ years as a litigation paralegal in federal court is a minimum

• Central District of California experience is required. You must have personally filed and managed matters in CDCA and be fluent in its local rules, standing orders, and Judges’ Procedures. Exposure to other federal districts is a plus but not required — the other jurisdictions on this docket have less local rules to follow.

• Copyright, IP, or related litigation experience strongly preferred. Photographer or author rights work is ideal; entertainment, DMCA, music, or trademark litigation is a close second.

• Working knowledge of the Copyright Act and the copyright damages framework, including statutory vs. actual damages under § 504, the registration-timing rules under § 412 that gate statutory damages and attorneys’ fees, and CMI damages under § 1203.

• Hands-on experience with the U.S. Copyright Office registration process — eCO filings, group registrations for photographs (GRPPH, GRUW), and supplementary registrations under § 408(d).

• Self-directed. This is a remote role on a small team that may convert to office based— you will not be micromanaged but need to be accessible, even on some weekends and nights with filing deadlines. You must have access to a dedicated work space at home that is quiet to attend court hearings via Zoom and other calls

• Paralegal certificate, legal studies degree, or equivalent experience. NALA or NFPA certification is a plus, not a requirement. Must have a 4 year college degree

Compensation

$80,000+ base depending on experience, plus bonuses tied to case outcomes. Fully remote within the U.S. Occasional travel for trial.
