Job Location: Address: 2005 N Central Avenue; Phoenix, AZ 85004 Posting Details: Salary: $71,500 - $121,000 Grade: 1 Closing Date: Open Until Filled Job Summary: The Arizona Attorney General's Office Civil Litigation Division/Division of Civil Rights Section is seeking a Senior Litigation Counsel. This position will be responsible for litigating complaints alleging violations of the Arizona Civil Rights Act. Will conduct all phases of civil rights litigation including discovery, motion practice, trial and appeals in administrative hearings, state superior court, federal court and also at the appellate level, where necessary, including complex litigation. Will conduct inquiries into allegations of broad-based discrimination; education and outreach; and be able to conciliate and mediation cases. As directed by Chief Counsel, will handle special projects and assist in civil litigation efforts throughout the Section particularly complex litigation and trial practice in the area of civil rights. Will mentor and advise newer, less experienced attorneys, providing advice, consultation, work review, and co-counseling. Will develop section cooperation to enhance the Office's ability to respond to litigation emergencies and participate in major litigation. Will assume responsibility for own individual assignments and also serve as a section resource, providing advice, information, and support to other attorneys, staff, and management. Employee will provide legal assistance, guidance, and expertise to other Division staff, as assigned, in connection with administrative filing and investigations of charges/complaints of discrimination under the Arizona Civil Rights Act, and will participate in intra-agency initiatives. Will provide written and oral legal opinions and advice on a wide variety of legal and policy issues that arise related to the Arizona Civil Rights Act. May assist in legislative and community education efforts and outreach. Will participate and coordinate with other attorney general offices in multi-state litigation and other activities. Employee will be responsible for timely and accurate legal and factual research and preparation of work products described above. In his/her role as the Division's legal representative in discrimination cases brought by the State, employee is responsible for creating quality work product, adhering to policies and procedures, meeting statutory and agency deadlines, and meeting all ethical obligations. This position may offer the ability to work remotely two days a week, based upon the department's business needs and continual meeting of expected performance measures. Job Duties: Will conduct all phases of Civil Rights litigation including discovery, motion practice, trial and appeals in administrative hearings, state superior court, federal court and also at the appellate level, where necessary, including complex litigation. Will serve as a section resource, providing advice, information, and support to other attorneys, staff, and management and will provide legal assistance, guidance, and expertise to other Division staff, as assigned, in connection with administrative filing and investigations of charges/complaints of discrimination under the Arizona Civil Rights Act, and will participate in intra-agency initiatives Will mentor and advise newer, less experienced attorneys, providing advice, consultation, work review, and co-counseling. Negotiate and draft mediation agreements, conciliation agreement, and consent decrees Will provide written and oral legal opinions and advice on a wide variety of legal and policy issues that arise in the Civil Rights Division Knowledge, Skills & Abilities (KSAs):
  • Considerable knowledge of Federal and State civil rights laws.
  • Knowledge of the legal system; state and federal court systems; state and federal Rules of Civil Procedure and Evidence; and pertinent statutes, regulations, and court decisions.
  • Considerable knowledge in litigating complaints alleging violations of the Arizona Civil Rights Act.
  • Knowledge of local rules of court and legal document formats.
  • Knowledge of legal techniques and basic concepts of American Jurisprudence.
  • Legal and factual issue analysis.
  • Legal research, legal writing, oral presentation, and negotiation.
  • Trial skills, negotiating skills, and investigative skills.
  • Other skills include advocacy, public speaking, and media communications.
  • Ability to identify issues and prepare analysis of legal documents and records.
  • Ability to prepare efficiently quality legal documents, memoranda, and correspondence.
  • Ability to make oral arguments and conduct trials in state and federal courts.
  • Ability to interact with and obtain information from representatives of Civil Rights Division, parties and witnesses, opposing counsel and personnel from various other agencies and courts.
  • Ability to provide continuing education or training.
  • Ability to work closely with law enforcement personnel as well as witnesses.
Selective Preference(s): Ideal candidate will have 10 years civil litigation experience. Pre-Employment Requirements:
  • Travel is required for this position. A valid Arizona Driver's License is required, along with consent to have your driving record run periodically.
  • Admission to, and good standing with, the Arizona State Bar is required (include on resume the date(s) of admission in Arizona and any other states). Candidate must have an active Arizona State Bar license.
  • Attorney applicants are required to submit a writing sample with their resume/application profile.
  • The writing sample should contain an analysis of some substantive legal issue and provide insight concerning your ability to think and to explain and advocate for a particular position.
