Pharmacist in Charge

BASIC FUNCTION

The Pharmacist in Charge (PIC) - Class D Clinic Pharmacy is responsible for the lawful, safe, and compliant operation of the assigned Texas Class D clinic pharmacy or pharmacies. The PIC provides continuous pharmacist supervision of pharmacy-related activities; develops and maintains the clinic formulary and pharmacy policies and procedures; oversees procurement, storage, provision, dispensing, records, security, and quality controls; conducts or ensures required on-site pharmacist visits and staff training; and serves as a member of the clinic Pharmacy and Therapeutics Committee. The role ensures compliance with the Texas Pharmacy Act and Texas State Board of Pharmacy (TSBP) rules governing Clinic Pharmacy (Class D), including 22 TAC §§291.91-291.94 and other applicable rules.

PRIMARY RESPONSIBILITIES AND DUTIES

1. Serve as Pharmacist in Charge for the Class D clinic pharmacy

a. Serve as the pharmacist designated on the Class D pharmacy license and remain responsible for the pharmacy's compliance with laws and rules pertaining to the practice of pharmacy. A Class D pharmacy must have one PIC who is employed or under written agreement at least on a part-time basis; the PIC may be employed full-time and may serve as PIC of more than one Class D clinic pharmacy. (22 TAC §291.91(15); §291.92(a)(1)(A))

b. Maintain a written agreement between the clinic and the PIC and ensure a copy is available to TSBP upon request. (22 TAC §291.92(a)(1)(B))

c. Ensure the Class D license is used only for a clinic setting other than a physician's office and only for limited types of dangerous drugs or devices listed in and approved for the clinic formulary. (22 TAC §291.91(4), (11)-(12); §291.93(e))

d. Ensure TSBP is notified in writing within 10 days of a change in the PIC, staff pharmacist, or consultant pharmacist and support required notifications for changes in ownership, name, location, temporary-clinic information, or pharmacy closure. (22 TAC §291.93(a)(1)(D)-(H), (a)(2)(G))

1. Provide continuous supervision of pharmacy-related activities and personnel

a. Provide continuous supervision of registered nurses, licensed vocational nurses, physician assistants, pharmacy technicians, pharmacy technician trainees, and assistants who perform pharmacy-related aspects of drug or device provision. Continuous supervision includes on-site and telephone supervision, routine inspection, and maintenance and use of an approved policy and procedure manual. (22 TAC §291.91(6); §291.92(a)(2)(A))

b. Ensure supportive personnel possess the education and training necessary to perform assigned pharmacy tasks and operate only within duties permitted by TSBP rules. (22 TAC §291.92(d)(1)-(2))

c. Designate, from among supportive personnel, an individual to supervise the day-to-day pharmacy-related operations of the clinic when a pharmacist is absent. (22 TAC §291.92(d)(3))

d. Conduct in-service training at least annually for supportive personnel who provide drugs, covering actions, contraindications, adverse reactions, and pharmacology of drugs contained in the formulary. (22 TAC §291.92(a)(2)(J))

e. Ensure prepackaging and labeling performed by supportive personnel occurs only under direct pharmacist supervision, with required in-process/final checks and pharmacist sign-off or electronic signature on quality-control records. (22 TAC §291.92(d)(2)(A); §291.93(e)(4)-(5); §291.94(c)-(d))

1. Lead formulary governance and the Pharmacy and Therapeutics Committee

a. Develop and maintain the clinic formulary in conjunction with the clinic Pharmacy and Therapeutics (P&T) Committee based on the objectives of the clinic. (22 TAC §291.92(a)(2)(C); §291.93(e)(1))

b. Serve on the P&T Committee, which must include at least three persons: the PIC, the clinic medical director, and a person responsible for provision of drugs and devices. Ensure the committee meets at least annually to review and update the policy and procedure manual and, when applicable, review retrospective drug-utilization-review reports. (22 TAC §291.93(f))

c. Ensure the standard Class D formulary is limited, exclusive of injectable drugs for administration in the clinic and nonprescription drugs, to anti-infective drugs, musculoskeletal drugs, vitamins, obstetrical and gynecological drugs/devices, topical drugs, and serums, toxoids, and vaccines unless an expanded formulary is approved by TSBP. (22 TAC §291.93(e)(1)(B))

d. Ensure the formulary does not contain nalbuphine (Nubain), drugs used to treat erectile dysfunction, or Schedule I-V controlled substances. (22 TAC §291.93(e)(1)(C))

e. If the clinic operates under a TSBP-approved expanded formulary, ensure eligibility and petition requirements are met, including the 80% indigent-patient criterion, required affidavit and documentation, resubmission every two years with pharmacy renewal, and prior Board approval before adding additional drugs. (22 TAC §291.93(e)(1)(D)(i)-(iii))

f. For an expanded formulary, ensure supportive personnel who provide drugs are licensed nurses or practitioners; required monthly pharmacist visits occur; policies address drugs requiring special monitoring; quarterly retrospective drug-regimen reviews are performed on a random sample of patients; and reports are submitted to the medical director and P&T Committee. Apply additional antipsychotic-monitoring requirements when applicable. (22 TAC §291.93(e)(1)(D)(iv))

1. Oversee procurement, storage, security, equipment, and drug accountability

a. Oversee procurement and storage of drugs and devices, determine specifications for all drugs and devices procured by the clinic, and maintain accurate control and accountability for all pharmacy transactions. (22 TAC §291.92(a)(2)(D)-(F))

b. Ensure dangerous drugs and devices are stored only in designated, secured areas accessible to authorized personnel; storage areas must be locked to prevent unauthorized access. Maintain adequate safeguards against theft or diversion and consult with clinic personnel regarding pharmacy security. (22 TAC §291.93(b)(2))

c. Ensure drugs are stored at proper temperatures; expired drugs or devices are not administered, provided, or dispensed; outdated items are removed from stock and quarantined pending disposition; and controlled substances are not stored in the Class D pharmacy. (22 TAC §291.93(e)(2))

d. Ensure drug samples on the Class D formulary are stored, labeled, provided, or dispensed under the same requirements as dangerous drugs; controlled-substance samples may not be stored, provided, or dispensed. (22 TAC §291.93(e)(3))

e. Ensure required equipment and supplies are maintained, including appropriate containers and labels for prepackaging, refrigerator/freezer capability when drugs require refrigerated/frozen storage, and an appropriate prescription or analytical balance when compounding. If such a balance is used, ensure inspection at least every three years by the appropriate authority. (22 TAC §291.93(c))

f. Maintain required pharmacy reference materials, including current Texas Pharmacy Act/rules, Texas Dangerous Drug Act, and at least two qualifying drug-information/reference resources in hard copy or electronic format. (22 TAC §291.93(d))

g. Ensure the Class D pharmacy maintains a clean and sanitary environment, complies with federal/state/local health requirements, and has a sanitary sink with hot and cold running water available to pharmacy personnel. (22 TAC §291.93(b)(1))

1. Control prepackaging, labeling, provision, dispensing, delivery, and compounding

a. Ensure drugs prepackaged for provision are for the internal use of the clinic, are placed in suitable containers, are prepackaged by a pharmacist or supportive personnel under direct pharmacist supervision, and bear all required labeling information. (22 TAC §291.93(e)(4))

b. Ensure drugs or devices in original manufacturer containers are appropriately labeled before provision; when supportive personnel perform labeling, quarantine the drug/device and required control records until checked and released by a pharmacist. (22 TAC §291.93(e)(5))

c. Ensure drugs and devices are provided only to patients of the clinic, only if listed in the clinic formulary, only in prepackaged quantities or original manufacturer containers, and only under continuous pharmacist supervision pursuant to standing delegation orders or standing medical orders and written policies and procedures. (22 TAC §291.93(e)(6)(A), (C)-(F))

d. Ensure the clinic maintains a system of control and accountability for all drugs and devices provided; this system shall be developed and supervised by the PIC. (22 TAC §291.93(e)(6)(D))

e. Ensure initial patient provision includes verbal and written drug/device information from a licensed nurse or practitioner regarding side effects, interactions, and precautions. When subsequent provisions are delivered to a residence or other designated location, ensure written information accompanies the medication, temperature/stability is protected, and the delivery system ensures receipt by the appropriate patient. (22 TAC §291.93(e)(6)(B))

f. Ensure required patient-specific label information is completed at provision and that only authorized personnel add information permitted by the rule. (22 TAC §291.93(e)(6)(G))

g. Prohibit storage, provision, and dispensing of controlled substances in the Class D pharmacy. (22 TAC §291.93(e)(2)(E), (e)(3)(B), (e)(6)(I))

h. Ensure dangerous drugs are dispensed only by a pharmacist pursuant to a prescription drug order and in accordance with applicable Class A dispensing requirements. Ensure non-sterile compounding, if performed, complies with 22 TAC §291.131. (22 TAC §291.93(e)(6)(J), (e)(7))

1. Develop, implement, and maintain the Class D policy and procedure manual

a. Develop and review the pharmacy policy and procedure manual at least annually in conjunction with the P&T Committee and implement the approved policies and procedures. (22 TAC §291.92(a)(2)(G); §291.93(f)-(g))

b. Ensure the manual contains a current list of the PIC, consultant pharmacist, staff pharmacists, supportive personnel designated to provide drugs/devices, and the supportive person designated to supervise day-to-day pharmacy-related operations in a pharmacist's absence; functions of pharmacy personnel; clinic objectives; formulary; written PIC agreement; and date of last review/revision. (22 TAC §291.93(g)(2)(A)-(F))

c. Maintain written policies and procedures addressing, at minimum: security; equipment; sanitation; licensing; reference materials; storage; packaging/repackaging; dispensing; provision; retrospective drug-regimen review; supervision; labeling/relabeling; samples; drug destruction and returns; drug/device procurement; receiving; delivery; recordkeeping; and inspection. (22 TAC §291.93(g)(2)(G)(i)-(xix))

1. Perform required pharmacist visits, inspections, and regulatory oversight

a. Ensure the PIC, consultant pharmacist, or staff pharmacist personally visits the clinic at least monthly to verify compliance with established policies and procedures, unless TSBP has approved an alternative visitation schedule for an eligible clinic. (22 TAC §291.93(h))

b. Maintain documentation of every required on-site visit, including the date, pharmacist's evaluation of findings, and signature of the visiting pharmacist. (22 TAC §291.94(b))

c. For eligible state/local-government-operated or government-funded clinics seeking an alternative visitation schedule, participate in the required petition and affidavit process and ensure the petition is resubmitted every two years with pharmacy renewal. (22 TAC §291.93(h)(1)-(3))

d. Meet TSBP inspection requirements and ensure the clinic pharmacy is inspection-ready, with required records, policies, formulary, agreements, security, equipment, and operational controls available for review. (22 TAC §291.92(a)(2)(H); §§291.93-291.94)

1. Maintain Class D pharmacy records and document retention

a. Ensure inventories and records required under Class D rules are maintained by the pharmacy and available for inspection and copying for at least two years from the date of the record. (22 TAC §291.94(a)(1)(A))

b. Provide requested records to TSBP within 72 hours. If electronic records are specifically requested, provide them in a mutually agreeable electronic format. (22 TAC §291.94(a)(1)(B))

c. Ensure alternative electronic/data-retention systems contain all information required on the manual record and can produce a hard copy upon request. (22 TAC §291.94(a)(2))

d. Ensure invoices and records of receipt kept outside the pharmacy can be supplied to TSBP within 72 hours of request. (22 TAC §291.94(a)(3))

e. Maintain complete records for on-site visits, prepackaging, labeling of original manufacturer containers, and each provision of drugs/devices, including the specific data elements required by §291.94(b)-(e).

1. Oversee temporary clinic sites when applicable

a. When the Class D pharmacy operates temporary clinic locations, ensure the permanent Class D location remains the address of record and the location where all dangerous drugs and records are stored. (22 TAC §291.93(a)(2)(B), (D))

b. Ensure no dangerous drugs are stored or left for patient pickup at temporary locations; drugs must be returned daily to the permanent location or secured mobile unit parked at the Class D pharmacy location with appropriate temperature controls. (22 TAC §291.93(a)(2)(C))

c. Ensure no more than six temporary locations operate simultaneously and TSBP is notified of the temporary locations and schedules, as well as changes in address, closure, or operating schedule within 10 days. (22 TAC §291.93(a)(2)(E)-(G))

1. Provide pharmacy leadership, quality, and interdisciplinary collaboration

a. Collaborate with the medical director, clinic leadership, nursing, providers, and supportive personnel to ensure safe medication-use systems that support clinic objectives and comply with the Class D scope of practice.

b. Monitor medication safety, formulary compliance, storage conditions, labeling, provision practices, incident trends, and corrective actions; escalate significant compliance or patient-safety concerns to appropriate leadership.

c. Maintain professional competence and current knowledge of the Texas Pharmacy Act, TSBP rules, Texas Dangerous Drug Act, applicable federal requirements, and changes affecting Class D clinic pharmacy practice.

REGULATORY SCOPE NOTE

This job description is written for a Texas Clinic Pharmacy (Class D). TSBP defines a Class D clinic as a location other than a physician's office where limited formulary drugs/devices are stored, administered, provided, or dispensed to outpatients. These requirements were verified against the current TSBP Texas Pharmacy Rules available August 25, 2026. Additional requirements may apply based on services performed, including non-sterile compounding, prescription dispensing, remote services, or other pharmacy activities.

1. Proficient with pharmacy information systems, electronic health records, inventory and wholesaler systems, electronic regulatory records, and standard office applications.
   2) Able to maintain audit-ready regulatory documentation, formulary records, training records, visit logs, drug-accountability records, and temperature/storage records.
