Trial Attorney

The PeterSan Group and PeterSan Legal Staffing

We are seeking a Litigation Attorney in either Austin, TX or Washington, DC for a pre-IPO client of mine in the energy industry. This role is ideal for a hands- on litigator with a proven track record representing companies in plaintiff-side and defensive employment disputes, trade secret misappropriation matters, restrictive covenant enforcement, and employee misconduct cases. With deep expertise in employment litigation, the successful candidate will be a strategic, aggressive advocate who thrives in adversarial situations and has significant courtroom, trial, and first- chair litigation experience. Key Responsibilities Lead all phases of complex litigation, including case strategy, pleadings, discovery, motion practice, depositions, hearings, trials, and appeals. Handle employment- related disputes involving wrongful termination, employee misconduct, restrictive covenants, non- compete enforcement, and confidential information theft. Drive trade secret and intellectual property litigation matters, including claims under the Defend Trade Secrets Act (DTSA) and applicable state laws. Pursue and defend emergency relief actions, including TROs, preliminary injunctions, preservation orders, and other expedited remedies. Conduct internal investigations involving employee misconduct, policy violations, and potential misappropriation of company assets or intellectual property. Partner with executive leadership to assess litigation risk, develop legal strategy, and protect company interests. Manage outside counsel while maintaining ownership of litigation strategy and execution. Qualifications J.D. from an accredited law school and active bar membership. 8–15 years of litigation experience, preferably combining top law firm training with meaningful in- house litigation responsibility. Significant first- chair litigation and courtroom experience, including trials, evidentiary hearings, depositions, and oral arguments. Demonstrated success obtaining favorable outcomes through trial, dispositive motions, injunctions, TROs, or strategic settlements. Deep expertise in employment litigation, trade secret misappropriation, restrictive covenant enforcement, and employee departure disputes. Strong experience managing discovery, taking, and defending depositions, and owning summary judgment and other dispositive motion practice. Experience conducting internal investigations and advising business leaders on employment- related legal risks.
