Examining Attorney (Managerial - 3011a)The New York City Department of Investigation (DOI) is one of the oldest law enforcement agencies in the country; its mission is to combat municipal corruption. DOI serves the people of New York City by acting as an independent and nonpartisan watchdog for New York City government, City agencies, and City employees, vendors with City contracts, individuals and entities that receive City funds. The Deputy Commissioner/Chief Compliance and Equal Employment Opportunity Officer will report to the Commissioner and have dotted-line reporting obligations to the DOI General Counsel and Deputy Commissioner/Chief of Investigations, as necessary depending on the work involved. As DOI's Chief Compliance Officer, the candidate will be responsible for agency risk mitigation; development and implementation of appropriate internal controls, including policies and procedures intended to ensure compliance with applicable legal and regulatory obligations; training and educating staff on compliance-related obligations; and management of internal complaints and investigations. The role includes, but is not limited to, the following tasks: Manage the development, review, revision and implementation of agency policies, including those related to investigations and operations, such as the Code of Conduct, the Employee Manual, and Operational and Investigative Division policies, to ensure compliance with legal and regulatory requirements. Provide guidance and recommendations on operational matters involving compliance, ethics, internal controls, and enterprise risk management. Oversee and/or collaborate on internal and external audits, including forfeiture spending audits, the Executive Order No. 86 audit, eJustice audits, and any other audits that may arise or be needed. Monitor and oversee the agency's compliance with statutory, regulatory, and other reporting requirements. Conduct internal investigations involving allegations of misconduct or violations of DOI policy or other compliance-related concerns. Participate in the Investigator Training Program, including by leading training related to agency policies, procedures, compliance obligations, and ethical responsibilities. Perform other executive-level responsibilities as directed by the Commissioner, including, but not limited to, collaborating with DOI's Investigations Division, Operations Division, and General Counsel's Office to interpret and apply laws, rules, regulations, and best practices to agency operations. Conduct impartial investigations into discrimination, harassment, retaliation, and other violations of applicable EEO laws and City policy. Provide training and advice to agency staff on EEO-related best practices, monitor agency compliance with mandatory EEO training requirements, and coordinate with agency stakeholders to ensure timely completion of required trainings. Review and make determinations as to Reasonable Accommodation requests and, as appropriate, engage in the interactive process with employees and management concerning such requests. Prepare and submit the City's Annual EEO Plan and other required citywide reports. Monitor and review employment practices, including recruitment, hiring, promotions, transfers, and separations, to identify potential barriers to equal employment opportunity and ensure compliance with applicable laws and City policy. Analyze workforce data and employment trends and recommend strategies to promote equal employment opportunity. Serve as the agency liaison with Department of Citywide Administrative Services, the Equal Employment Practices Commission, the NYC Commission on Human Rights, and other oversight agencies on EEO-related matters. Maintain confidential investigative files, records, and documentation in accordance with applicable policies and legal requirements. Perform other related duties as assigned. If selected, the candidate will be fingerprinted and undergo a background investigation. In addition, for positions that have a law enforcement and/or investigative function, the candidate's consumer credit history will be reviewed during the background investigation, and as otherwise permitted by NYC Administrative Code 8-107(24)(b)(2)(A).Minimum QualificationsJuris Doctor (JD) degree from an ABA-accredited law school; Active bar membership from any of the 50 states, District of Columbia, Puerto Rico, or the US Virgin Islands; a minimum of three years of recent full-time relevant legal experience subsequent to admission to any bar.Preferred SkillsA minimum of ten (10) years of experience in compliance, investigations, law, and/or a related field. Demonstrated experience with EEO matters, including EEO-related compliance and investigations. Outstanding verbal and written communication skills. Proven innovative proactive and collaborative leadership style. Experience with New York City government operations, policies, and procedures. Proven ability to handle highly confidential and sensitive information.
