Real Estate Attorney - LIHTC (Low-Income Housing Tax Credit)

About the Opportunity

Our client is seeking an experienced Real Estate Attorney with a strong background in Low-Income Housing Tax Credit (LIHTC) transactions to join its growing Affordable Housing practice. This is an excellent opportunity to work on sophisticated, mission-driven real estate transactions while advising developers, investors, lenders, and public agencies on affordable housing developments across the country.


The ideal candidate is a collaborative attorney who thrives in a fast-paced environment and has a deep understanding of affordable housing finance and complex real estate transactions.

Key Responsibilities

• Structure, negotiate, and close LIHTC transactions from inception through closing.
• Draft and negotiate purchase and sale agreements, financing documents, partnership agreements, and development agreements.
• Advise clients on affordable housing regulations, tax credit compliance, and related federal, state, and local housing programs.
• Coordinate with developers, investors, lenders, government agencies, and opposing counsel throughout transactions.
• Conduct legal due diligence, review title and survey matters, and identify transactional risks.
• Provide strategic legal guidance on multifamily affordable housing developments and mixed-finance projects.
• Mentor junior attorneys and support business development initiatives, as appropriate.

Qualifications

• J.D. from an accredited law school.
• Active license to practice law in the state of New York.
• 5+ years of experience handling commercial real estate transactions, with significant LIHTC experience.
• Demonstrated knowledge of affordable housing finance, tax credit structures, and real estate development.
• Experience representing developers, syndicators, investors, lenders, or housing authorities is highly preferred.
• Excellent drafting, negotiation, and client counseling skills.
• Strong organizational skills with the ability to manage multiple complex transactions simultaneously.

Preferred Experience

• Experience with HUD, FHA, USDA Rural Development, tax-exempt bonds, HOME, or CDBG financing.
• Familiarity with Section 8, public-private partnerships, or mixed-use developments.
• Portable business is welcomed but not required.
