Position Overview
Howard Law, P.A. is seeking an experienced Foreclosure Attorney to join our growing practice. The ideal candidate is a licensed Florida attorney with hands-on residential and/or commercial foreclosure experience who thrives in a high-volume environment and is comfortable managing a substantial active docket. This role carries real responsibility: you will own files from referral through certificate of title, interact directly with clients and opposing counsel, and serve as a substantive resource for paralegal staff. Key Responsibilities
- Manage a high-volume docket of Florida (and Georgia) foreclosure matters from referral intake through certificate of title issuance, including judicial and non-judicial proceedings.
- Draft, review, and file pleadings, motions, affidavits, and orders in compliance with Florida Rules of Civil Procedure and applicable investor/servicer guidelines.
- Appear at hearings, including summary judgment hearings, case management conferences, mediations, and contested motions, in Florida circuit courts.
- Supervise and provide substantive guidance to paralegal staff on file progression, CaseAware step completions, and billing trigger compliance.
- Handle contested foreclosure litigation matters, including responding to affirmative defenses, loss mitigation-related delays, and borrower objections.
- Coordinate with clients on file-level strategy, timeline updates, investor reporting requirements, and escalated matters.
- Review title work, manage cure of title defects, and coordinate with closing staff on post-sale and REO transactions.
- Ensure compliance with applicable state and federal regulations, including CFPB servicing rules, SCRA/MLA requirements, and investor-specific timelines.
- Assist with Georgia non-judicial foreclosure matters, including NOI compliance under O.C.G.A. § 44-14-162 and publication requirements.
- Participate in quality control review, file audits, and attorney team meetings as directed by firm management.
Qualifications
Required:
- Active Florida Bar license in good standing (Georgia Bar or willingness to obtain a plus).
- Minimum 2 years of residential foreclosure experience in Florida; multi-state or commercial foreclosure experience welcomed.
- Demonstrated ability to manage a high-volume docket independently with minimal supervision.
- Familiarity with Florida Rules of Civil Procedure, including the 2021/2025 amendments to Rule 1.510 (summary judgment standard).
- Proficiency with case management systems; CaseAware experience strongly preferred.
- Strong written and verbal communication skills for client-facing and court interactions.
- Ability to meet strict investor and servicer timeline requirements (FNMA, FHLMC, FHA, VA, private label).
Preferred:
- Experience with Georgia non-judicial foreclosure under O.C.G.A. § 44-14-162.
- Background in creditors' rights, loss mitigation, or post-judgment proceedings (writ of possession, redemption payoffs).
- Familiarity with LPS, ICE/MSP, or similar servicer-side platforms.
- Prior experience at a default services or creditors' rights firm.
- Comfort with appellate practice or § 57.105 fee motion practice.
