Suspension Hearing Officer, OSPP - 27206 Level: L2 Division/Office: Office of Safety and Prevention Partnerships Borough: Brooklyn Posting End Date: 10/05/2026 Description Position Summary: Reporting to the Supervising Attorney, the Suspension Hearing Officer will preside at and oversee student suspensions hearings for students with disabilities or in general education programs. Performs related work. Reports to: Supervising Attorney Direct Reports: N/A Key Relationships: Communicates with private and public legal and advocacy personnel, including individual attorneys/advocates representing suspended students. Communicates with parents/guardians regarding suspension related issues. Responsibilities Conducts administrative due process hearings at student suspension hearings and other administrative proceedings of superintendent suspension cases, administers oaths, hears testimony on the charge(s) brought against students, examines witnesses and tests the credibility of their testimony, examines documentary and other physical evidence, applies the rules of evidence, and renders decisions on evidentiary procedural objections raised during the proceedings. Conducts pre-hearing conferences at designated hearing locations throughout the five boroughs of New York City, as assigned. Advises students and parents regarding their due process rights; explains hearing procedures, no-contest plea options, and the formal hearing process. Communicates with parents/guardians regarding suspension related issues. Prepares findings of fact and recommends appropriate measures of discipline; writes decision letters for review and approval by the Supervising attorney ensuring compliance with the Chancellor’s Regulations A-443 and all applicable timelines and procedural requirements. Exercises independent judgement in rendering fair, impartial and equitable decisions on behalf of New York City Public Schools (NYCPS). Qualification Requirements Minimum Admission to the New York State Bar; and either 2 or 3 below. One year of satisfactory United States legal experience subsequent to admission to any state bar; or Six months of satisfactory service as an Agency Attorney Intern (30086). Note: In addition to meeting the minimum Qualification Requirements: To be assigned to AL II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. Note: Selected candidates must remain members of the New York State Bar in good standing for the duration of their employment. Plus In addition to meeting the minimum requirements, individuals must have two additional years of relevant work experience. Preferred Hearings are conducted in person, so this position is full-time in the office when schools are in session. The opportunity to work a hybrid schedule is limited to school holiday breaks and summer. Ability to write clearly and concisely. Ability to rapidly understand provisions of applicable law and regulations. Excellent research, analytical and communications skills. Familiarity with NYCPS Chancellor’s Regulations pertaining to student discipline. Proficiency with Microsoft Office 365 Applications.
