Division Overview The State’s Attorney’s Office in the Montana Department of Justice is dedicated to ensuring justice and upholding the rule of law on behalf of the people of Montana. The office includes the Solicitor General’s Office, Criminal Prosecution and Appellate Services, Civil Services and Consumer Protection, and handles defense of state laws, constitutional challenges, and complex litigation. Job Overview The Montana Solicitor General’s Office seeks a Deputy Solicitor General to serve as the chief litigator for the State. The role oversees appellate litigation, including the United States Supreme Court, Montana Supreme Court, and the U.S. Court of Appeals for the Ninth Circuit, as well as offensive federal litigation and defense of constitutional challenges. The Deputy Solicitor General reports directly to the Solicitor General and supervises assistant solicitors, fellows, and interns. Responsibilities Develop case strategy and prepare briefs and oral arguments for the United States Supreme Court, Montana Supreme Court, Ninth Circuit, and other federal courts. Conduct thorough legal research on issues of law. Review and draft multi‑state amicus briefs. Draft Attorney General opinions and federal agency comments. Provide legal advice and policy recommendations for the Attorney General. Qualifications Juris Doctor degree. At least five years of specialized law and litigation experience. Admission to and maintenance of licensure from the State Bar of Montana. Legal practice in another state and ability to become licensed in Montana within six months. Judicial clerkship experience preferred. Familiarity with and interest in federal constitutional law and statutory interpretation. Commitment to advocating for the interests of the State of Montana. Other combinations of education and experience will be considered on a case‑by‑case basis. Benefits & Compensation Salary: $57.69 per hour.
