SUMMARY This position is part of the City Attorney’s Office and is responsible for providing comprehensive legal services and representation to the Mayor, City Council, City Manager, and City Departments, specifically on matters involving Charlotte Water, and Storm Water Services (a division within Charlotte Water), with a focus on matters involving Compliance & Enforcement. This position will perform work in close conjunction with and through the direct oversight of and consultation with the One Water legal team supervisor. The position will be physically located at a Charlotte Water/Storm Water Services facility. MAJOR DUTIES AND RESPONSIBILITIES Research and advise on compliance with local, state, and federal laws specific to municipal water, wastewater, and storm water operations.

Perform all tasks associated with the fulfillment of public records by Charlotte Water and Storm Water Services and through the direct oversight of and consultation with the One Water legal team supervisor.

Provide legal advice and counsel through the direct oversight of and consultation with the One Water legal team supervisor on matters involving customer disputes over billing, invoices, or disconnections.

Support information technology operations through the direct oversight of and consultation with the One Water legal team supervisor while ensuring compliance with all federal and state laws concerning privacy and personally identifiable information.

Provide legal advice and counsel through the direct oversight of and consultation with the One Water legal team supervisor on 811 claims involving Charlotte Water and Storm Water Services.

Provide legal advice and counsel through the direct oversight of and consultation with the One Water legal team supervisor to support the security operations of Charlotte Water and Storm Water.

Perform all tasks through the direct oversight of and consultation with the One Water legal team supervisor to ensure Charlotte Water’s and Storm Water Services’ compliance with all environmental regulations.

Provide legal advice and counsel through the direct oversight of and consultation with the One Water legal team supervisor during any administrative hearing involving Charlotte Water or Storm Water Services.

Provide legal guidance and counsel through the direct oversight of and consultation with the One Water legal team supervisor on matters involving trademarks and intellectual property.

Conduct legal research and render legal opinions.

Represent and advocated on behalf of the City in litigation at all levels of federal and state courts as may be required including through oral arguments or appellate briefs

Resolve any operational and business issues in a manner that supports the priorities of Charlotte Water and Storm Water Services.

Negotiate and draft documents through the direct oversight of and consultation with the One Water legal team supervisor such as contracts, memorandums of understanding, agreements, and other documents needed to accomplish the operational and business needs of Charlotte Water and Storm Water Services.

KNOWLEDGE, SKILLS & ABILITIES Knowledge of constitutional, federal, state, and local laws affecting municipal government and specifically water, wastewater, and storm water operations.

Ability to work collaboratively with others, analyze non-complex issues from a legal, policy, and practical perspective, and provide clear advice and counsel.

Ability to master new material quickly, manage a diverse legal portfolio, and handle a fast-paced environment.

Knowledge of local rules, judicial procedures, and rules of evidence

MINIMUM QUALIFICATIONS Juris Doctorate degree from an ABA accredited law school.

A current license to practice law in North Carolina.

Candidates may submit an application if the candidate’s North Carolina license is pending.

Entry level, no work experience necessary for Assistant City Attorney Associate.

CONDITIONS OF EMPLOYMENT The City’s Background Check Policy requires background checks to be conducted on final internal or external candidate(s) applying for any position with the City of Charlotte.
