Provide oversight for all programmatic-related legal needs. Maintain the Administrative Rules for the Medical Cannabis Program, revising them as needed in collaboration with the Program Director on a continuous basis. Draft final guidance on ambiguous medical cannabis statute, administrative rules, and aspects of the medical cannabis program that may not be addressed in either as issues arise in collaboration with the Program Director. Collaborate on investigation findings and final actions with the Program Director, Investigator, and Compliance Inspector (if applicable) involving a) cultivation, processing, transportation, and disposal entities/licensees, b) certified practitioners, c) etc. Present State cases in administrative appeals to include a) relevant statute and rules research, b) hearing prep with compliance officers, and c) drafting final orders for the State Health Officer. Attend local, state, and national gatherings/trainings to enhance professional and programmatic knowledge of the medical cannabis industry (in-person and virtual). A successful attorney in a medical cannabis regulatory program needs strong skills in administrative and regulatory law, statutory interpretation, licensing, compliance, enforcement, policy development, and navigating the intersection of state cannabis laws with federal requirements. They should also be effective communicators and problem-solvers who can balance patient access, public health, public safety, industry needs, and stakeholder interests while translating complex regulations into practical policies and procedures.
