Position Overview
We are seeking a focused and results-driven Pre-Litigation Attorney to manage personal injury and pre-suit matters from initial intake through resolution. The ideal candidate will evaluate claims, conduct factual and legal investigations, draft demand letters and correspondence, negotiate settlements, and prepare cases for litigation when necessary. This role requires strong client-facing skills, effective negotiation and drafting abilities, and the capacity to work closely with litigation teams to ensure seamless case transitions.

Key Responsibilities

• Manage a docket of pre-litigation personal injury matters from intake through resolution, ensuring timely progress and adherence to deadlines.
• Investigate claims by obtaining and reviewing medical records, accident reports, witness statements, and other evidence to assess liability and damages.
• Draft and serve demand letters, settlement proposals, releases, and other pre-suit correspondence and documents.
• Negotiate settlements with opposing counsel, insurance adjusters, and other parties to achieve favorable client outcomes while protecting firm interests.
• Advise and counsel clients on case strategy, realistic settlement expectations, potential litigation risks, and cost-benefit analyses.
• Prepare thorough pre-litigation case files, including chronologies, damage calculations, witness lists, and preservation of evidence, to facilitate efficient transition to litigation if necessary.
• Review, analyze, and, where appropriate, negotiate client contracts and retention agreements related to cases (nice-to-have responsibility).
• Coordinate with expert witnesses, medical providers, and investigative resources to support claim development and valuation.
• Perform legal research on applicable law, statutes of limitation, and precedents to inform demand strategy and settlement positions (nice-to-have responsibility).
• Maintain clear, timely communication with clients, opposing counsel, and internal teams, and document all case activity in the case management system.
• Work collaboratively with litigators to transfer cases that will proceed to filing, including preparing pleadings, exhibits, and case summaries.
• Ensure compliance with ethical standards, court rules, and firm policies in all pre-litigation activities.

Qualifications

• Juris Doctor (JD) degree from an accredited law school and active admission to practice in the relevant state bar.
• Minimum of 3 years of experience handling pre-litigation matters, with demonstrated experience in personal injury cases.
• Proven negotiation and settlement experience with a track record of resolving claims favorably for clients.
• Strong legal drafting skills, including demand letters, settlement agreements, releases, and correspondence.
• Excellent client counseling and interpersonal skills, with an ability to explain legal concepts and manage client expectations.
• Familiarity with evidence collection, medical records review, and damage evaluation techniques specific to personal injury matters.
• Experience using legal research tools (Westlaw, LexisNexis, or similar) and case management software; legal research experience is a plus.
• Experience reviewing and negotiating client contracts or retention agreements is a plus.
• Detail-oriented, organized, and able to manage multiple matters and deadlines independently.
• Professional integrity, sound judgment, and the ability to work collaboratively within a team.
