Job Description and Duties
Under the general direction of the Assistant Chief Counsel for the Division of Recycling, the Attorney IV will prepare cases and advise and represent the Department in complex administration actions, including hearings, application reviews, and settlement negotiations. The Attorney IV will act as liaison between the Department and the Attorney General's Office for civil and criminal proceedings. The Attorney IV will be responsible for researching and analyzing state and federal case law, statutes, regulations and procedures associated with the Department's programs, primarily the Beverage Container Recycling and Litter Reduction Act and its regulations. The Attorney IV will be expected to write briefs, accusations, memoranda and correspondence on complex and difficult legal matters. The Attorney IV will be expected to handle requests under the California Public Records Act. The Attorney IV will be expected have excellent written and verbal communications skills, and consistently to treat others with courtesy and respect.

Working Conditions
This position may be eligible for hybrid telework under Government Code 14200 for eligible applicants residing in California, subject to the candidate meeting telework eligibility criteria set forth in the CalEPA telework policy and/or future program need. Employees not residing in California are not eligible for telework. Regardless of telework eligibility, all employees may be required to report to the position’s designated headquarters location, as indicated on their duty statement, at their own expense.

Desirable Qualifications
In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
Preparing cases and advising and appearing in administrative actions including hearings, application reviews, and settlement negotiations.
Providing litigation support to the Attorney General's Office for civil and criminal proceedings.
Experience with preparing memoranda and briefs, conducting research in the areas of civil and administrative law.
Knowledge and familiarity with the California environmental regulatory laws, especially with regard to the California Beverage Container Recycling & Litter Reduction Act
