This is an excellent opportunity for an attorney who wants to build a sophisticated, highly specialized practice advising healthcare providers, organizations, investors, and businesses on complex regulatory, transactional, reimbursement, compliance, and enforcement matters. The successful candidate will work closely with experienced healthcare attorneys and have meaningful client contact, substantive responsibility, and exposure to matters involving federal and state healthcare regulations, business structuring, fraud and abuse, licensing, reimbursement, and government investigations. Compensation The anticipated base salary range is approximately $200,000–$325,000, depending on experience, qualifications, practice depth, market considerations, and the overall strength of the candidate’s background. Advise healthcare providers and businesses on federal and state regulatory requirements.
Counsel clients regarding the Anti-Kickback Statute, Stark Law, False Claims Act, fee-splitting restrictions, and corporate practice of medicine requirements.
Analyze proposed healthcare business arrangements and recommend compliant structures.
Draft and negotiate physician employment agreements, professional services agreements, management services agreements, medical director agreements, vendor agreements, and other healthcare contracts.
Advise physician groups, medical practices, pharmacies, laboratories, ambulatory surgery centers, behavioral health organizations, telehealth companies, and other healthcare entities.
Counsel clients on provider enrollment, credentialing, reimbursement, billing compliance, overpayments, audits, recoupments, and payor disputes.
Assist with healthcare transactions, including regulatory due diligence, change-of-ownership matters, licensing, entity structuring, and post-closing integration.
Advise on HIPAA, HITECH, business associate agreements, privacy, data use, and information-sharing requirements.
Develop and assess compliance programs, policies, procedures, and training materials.
Conduct internal compliance reviews and investigations.
Advise clients regarding voluntary disclosures, self-disclosures, and responses to government inquiries.
Prepare legal memoranda, regulatory analyses, client alerts, policies, agreements, and other client-facing work product.
Monitor developments in federal and state healthcare laws and provide practical guidance to clients.
Work collaboratively with attorneys across healthcare litigation, corporate, employment, pharmacy, reimbursement, and life sciences practices. Qualifications
Meaningful healthcare regulatory experience gained at a law firm, government agency, healthcare organization, or comparable legal environment.
Experience with several of the following:
