Litigation Attorney-Defense

Salary: $180k-$220k/yr

Location: Melville, NY (onsite, w 1-2 days hybrid options) Position Overview

We are seeking a skilled litigation attorney to join our defense practice, focusing on general liability, premises liability, and construction-related matters. The successful candidate will manage contested civil matters from intake through trial, advocate for clients in court and at mediation, and partner with internal teams and outside experts to achieve favorable outcomes. Candidates with handson trial experience who have served as both second and first chair are highly desired.

Key Responsibilities

• Manage a diverse caseload of defense litigation matters including general liability, premises liability, and construction claims from intake through disposition.
• Draft and respond to pleadings, motions, discovery requests and disclosures; prepare legal memoranda and strategy analyses.
• Conduct and defend depositions, take and prepare witness statements, and coordinate fact and expert discovery.
• Prepare trial materials: exhibits, witness lists, pretrial briefs, jury instructions, and motions in limine.
• Serve as second chair and first chair at trials and hearings; handle courtroom advocacy, examinations, and jury arguments.
• Negotiate settlements and handle mediation sessions on behalf of clients, coordinating with claims handlers and corporate clients.
• Work with experts (engineering, safety, construction) to develop case theory, prepare expert reports, and challenge opposing experts.
• Provide clear, timely communication to clients and claims teams, including case status updates, risk assessments, and cost analyses.
• Mentor and supervise junior attorneys, paralegals, and legal support staff to promote professional development and efficient case handling.
• Maintain compliance with ethical and court rules, manage docket and deadlines, and ensure accurate billing and file management.

Qualifications

• Juris Doctor (JD) from an accredited law school and active admission to the state Bar required.
• 3+ years of civil defense litigation experience; preference for 5+ years handling general liability, premises liability, and construction matters.
• Demonstrated trial experience, including serving as second chair and first chair in jury and bench trials.
• Proven ability to manage a high-volume caseload, develop litigation strategy, and achieve favorable outcomes in contested matters.
• Strong legal writing and oral advocacy skills, with experience drafting pleadings, dispositive motions, and trial briefs.
• Experience conducting depositions and working with expert witnesses in construction, engineering, or safety disciplines.
• Familiarity with court rules, evidence rules, and civil procedure relevant to state and federal practice.
• Excellent interpersonal skills and client-service orientation; ability to coordinate with insurers, claims professionals, and outside vendors.
• Willingness to travel to courts, client sites, and mediations as needed; valid drivers license and reliable transportation.
