This Attorney Manager II / Condemnation Section Head position is within the North Carolina Department of Justice/Attorney General’s Office representing the North Carolina Department of Transportation (DOT) in eminent domain/condemnation actions to assist DOT in its mission to connect people, products and places. The primary purpose of the position is to supervise the Condemnation Section of the Transportation Division of the Attorney General’s Office, which provides legal services to DOT. The Condemnation Section (Section) files and prosecutes condemnation actions on behalf of DOT and defends inverse condemnation actions filed by property owners against DOT. The legal services provided by the Section are essential to DOT in carrying out its mission. The Section consists of over 20 attorney positions, including - an Attorney Manager I position located in Asheville, Attorney Vs, Attorney IVs and Attorney IIIs - and ten plus Administrative Specialists and Paralegals. The position serves as the primary contact on condemnation matters to DOT’s Right-of-Way Division, the State Engineer, DOT’s General Counsel’s Office, and other DOT senior management. The position is charged with building and maintaining a responsive and collaborative relationship with DOT. The position is responsible for thoughtfully assigning direct and inverse condemnation cases considering project location, complexity and efficiencies. In consultation with DOT, the position will proactively develop litigation strategy, particularly for novel and evolving legal issues which have a statewide impact and ensure that the attorneys in the Section consistently implement the strategy. Due to the high volume of pending condemnation actions and the continuous filing of new condemnation actions, the position must effectively manage the resources within the Section and outside contractors when it is necessary for DOT to engage outside contractors to augment the legal services provided by the Section. The position will also perform other duties as assigned by the Senior Deputy of the Transportation Division or the Civil Bureau Chief. \*\*Some travel, including some occasional overnight stays are required**Knowledge Skills and Abilities/Management Preferences****Management Preferences:*** Strong interpersonal skills and a commitment to teamwork;* Ability to independently develop creative solutions to legal issues and management challenges;* Demonstrated ability to effectively collaborate with management, colleagues, team members, clients, and others, and to effectively lead a team of specialized professionals;* Demonstrated ability to identify process improvements and demonstrated ability to implement and accept change;* Litigation experience, including - working with expert witnesses, developing trial strategy, and conducting discovery, bench hearings and jury trials;* Familiarity with deeds, easements and other real estate documents;* Ability to multi-task and prioritize legal and management deadlines successfully.**Minimum Education and Experience**Some state job postings say you can qualify by an “equivalent combination of education and experience.” If that language appears below, then you may qualify through EITHER years of education OR years of directly related experience, OR a combination of both.
