Assistant General Counsel

Phoenix Children\'s is seeking an Assistant General Counsel with at least five (5) years of healthcare law experience in a law firm or in‑house legal department working successfully with hospitals or health systems. This position is responsible for ensuring Phoenix Children\'s is in compliance with applicable laws, rules and regulations. It also drafts and reviews contracts—including physician employment agreements, medical director agreements, real estate leases, equipment leases, research agreements and vendor and information technology contracts—and provides advice and guidance regarding compliance, medical staff issues, licensing, employment law, research, and business transactions. The role offers legal advice to clinical leaders, hospital staff and committees on a wide range of patient issues, including interfaces with external regulatory agencies and patients/families.

Position Duties

• Advises the hospital on regulatory compliance matters in conjunction with compliance and privacy officers, including conducting or overseeing regulatory investigations.
• Contributes to achieving established department goals and objectives and adheres to departmental policies and procedures.
• Oversees administrative functions relating to corporate filings, license renewals, and other documentation needs.
• Maintains knowledge of major federal laws relating to healthcare (e.g., fraud and abuse laws, Stark Law, EMTALA, HIPAA, and laws regarding tax‑exempt organizations) and state laws applicable to the hospital.
• Prepares document templates for recurrent use; standardizes contracts and forms and drafts legal documents unique to specific needs; represents the hospital in negotiations.
• Researches legal issues, identifies alternative courses of action and associated risks, and makes recommendations; maintains current knowledge of industry and regulatory developments.
• Reviews contracts and other legal documents for regulatory compliance and language unfavorable to the hospital; serves as clearinghouse for official notices and develops process for responding to subpoenas.
• Triages requests for legal assistance and provides legal analysis, advice and counsel to senior management and other employees on a wide range of legal issues.
• Performs miscellaneous job‑related duties as requested.

Position Qualifications

Education

• Juris Doctor from an ABA‑accredited College of Law with a strong academic background.

Experience

• At least five (5) years of healthcare law experience in a law firm or in‑house legal department working with hospitals or health systems, including healthcare contracting, research, regulatory matters and compliance.
• In‑depth experience in contract law with broad background in drafting and negotiating agreements across multiple business areas.
• Five (5) or more years of healthcare law experience representing a hospital or health system on regulatory and transactional matters.
• Knowledge and experience in healthcare technology and clinical research is helpful but not required.

Additional Requirements

• Current member of the Arizona State Bar, either by admission or as Registered In‑House Counsel, and obtains such status within the first six months of employment.
