Assistant County Attorney II (Litigation) - Non-Merit

General Overview Under general supervision of the County Attorney, Deputy County Attorney or designee(s), assists with litigation, operational, transactional and administrative matters concerning Baltimore County government. Essential Job Functions Conducts civil litigation on behalf of the Baltimore County government in the Circuit Court and District Court for Baltimore County, and the United States District Court for the District of Maryland and courts in other jurisdictions. Prosecutes and defends civil appeals on behalf of the Baltimore County government in the Maryland Court of Special Appeals, the Maryland Court of Appeals, the United States Court of Appeals (any Circuit), and the Supreme Court of the United States. Prepares the record and any appellate briefs for any civil appeal. Conducts legal research as necessary for litigation matters. Prepares and files briefs, memoranda of law, discovery tools, motions, settlement agreements and other legal documents necessary to conduct civil litigation. Conducts discovery in civil litigation cases, including depositions, interrogatories, requests for production of documents, and other discovery tools. Attends and represents the interests of the County in administrative proceedings, including hearings before boards, commissions, the worker’s compensation commission, and the State and County Office of Administrative Hearings. Attends and represents the interests of the County in negotiations with unions and various public and private organizations and groups. Drafts and prepares various legal documents that are not related to litigation, including contracts, deeds, leases, ordinances, collection letters and reports related to real estate transactions and tax sale properties. Defends the Baltimore County government against union grievance and/or charges of discrimination before state and federal agencies charged with enforcing anti-discrimination laws. Drafts and files position statements outlining the County’s response to union grievances and/or charges of discrimination. Advises the County Executive, the County Administrator, County agencies and the County Council on legal matters, as necessary. Appears before the County Council to discuss the legal sufficiency of proposed legislation. Performs all other duties within the Office of Law as assigned by the County Attorney or designee. Handles workers’ compensation cases, including reviewing and processing claims, participating in settlement negotiations, recommending loss control strategies, ensuring program conformance to applicable laws and regulations, preparing required reports, and monitoring and evaluating program activities. Conducts adjusting activities on behalf of the self‑insured employer, including investigating, negotiating, and managing claims against the County's Self Insurance Fund. Required Qualifications Graduation from an ABA accredited law school. Licensed to practice law in the State of Maryland, or eligible to waive into the bar of the State of Maryland. A law degree from an ABA accredited law school with four (4) to six (6) years of experience. Admission to the Bar of the State of Maryland is required. Knowledge, Skills, and Abilities Knowledge of the Maryland Rules and the Federal Rules of Civil Procedure, as well as the Local Rules for the United States District Court for the District of Maryland. Knowledge of applicable federal, state and local law. Knowledge of County best practices and procedures. Ability to manage and prioritize multiple complex matters. Exceptional oral and written communication skills. Ability to establish and maintain effective, collaborative working relationships with others inside and outside the Law Department. Ability to work independently and meet deadlines while handling multiple tasks. Ability to maintain professionalism under pressure. A strong sense of ownership of tasks and responsibilities. Strong interpersonal skills required to work with the public and various agencies. Strong technology skills, including the ability to coordinate and conduct electronic discovery, and proficiency with Microsoft Office software and legal research platforms such as Westlaw. Testing and Investigation Applicants selected for an appointment must successfully complete an employment background investigation, including a criminal background, education, and fingerprint check.
