Construction Defect Technical Claims Specialist

Role Overview The Construction Defect Technical Claims Specialist will adjust the most complex construction defect claims in the company’s inventory, helping the organization establish cost‑effective strategies for handling this claim type. Responsibilities Investigate, evaluate, and bring a portfolio of complex construction defect claims to timely resolution, many of which are litigated and involve large projects, while adhering to established claim‑handling standards and applicable state regulations. Handle complex coverage issues related to sub‑contractors, additional insured tenders, General Contractor and developer coverage, Florida Chapter 558 process, and issuance of reservation of rights and denial of coverage letters. Understand and interpret construction contracts, applying risk transfer when appropriate. Negotiate time on risk and the duty to defend and indemnify with liable insurers when appropriate. Manage litigation proactively and work with defense counsel and insureds to reach optimal outcomes. Utilize resolution techniques such as high‑low agreements, settlement proposals, and offers of judgment to obtain optimal outcomes. Respond timely to time‑limit demands, consumer complaints, and Department of Insurance Complaints, including Civil Remedy Notices often filed in construction defect claims. Review and analyze damage reports prepared by contractors, engineers, and appraisers to assess property damage and construction‑defect damages. Serve as an alternative dispute resolution negotiator in mediations and assist in early resolution efforts when appropriate. Apply reserving principles and maintain appropriate reserves on all assigned claim files. Prepare reports detailing claim status, payments, and reserves. Maintain an accurate claim diary and document the file throughout the adjustment process. Assist, train, and mentor less‑skilled team members in collaboration with management. Help managers identify trends and opportunities for process improvement to enhance overall outcomes. Collaborate with underwriting and other departments on projects or as needed. Qualifications Bachelor’s degree in a related field or equivalent experience; Juris Doctor preferred. Ten (10) years of construction defect claims adjusting experience with exposure to a minimum of $100,000 in claim size. Proper adjuster licenses in Florida and other states, with the ability to obtain additional licenses as required. In‑depth knowledge of construction defect claim handling, applicable insurance policies, claims systems, and regulations in 48 states.
