Deputy District Attorney III/IV (Writs and Appeals)

Overview The Riverside County District Attorney's Office seeks a Deputy District Attorney at the III or IV level to support the Writs and Appeals team under the Special Prosecutions Section. This position will be located in Riverside, but will assist with cases Countywide. As a Deputy District Attorney III/IV, the selected candidate will specialize in writs and appeals and other post-conviction work, in addition to traditional trial prosecution. This includes drafting appellate briefs, responding to writ petitions and habeas corpus matters, conducting comprehensive record review, preparing legal analyses and documents related to policy and legislation, evaluating and advising on Brady disclosure obligations, and performing other litigation and appellate duties as assigned. The department seeks candidates with strong appellate, civil, or regulatory experience who demonstrate exceptional legal research and writing skills. Experience in writs, appeals, or post-conviction matters is highly desirable. Relevant experience may include appellate practice, post-conviction litigation, Public Records Act and/or Freedom of Information Act, grand jury work, statewide civil litigation, State Bar or Judicial Council investigations or litigation, or other complex assignments. This position is eligible for a 9/80 schedule and may require travel throughout the Riverside County. Deputy District Attorney III/IV Salary Range Deputy District Attorney III: $65.87 - $86.34 hourly, $11,416.67 - $14,964.94 monthly, $137,000.00 - $179,579.25 annually. Deputy District Attorney IV: $69.29 - $103.35 hourly, $12,010.44 - $17,913.70 monthly, $144,125.25 - $214,964.46 annually. Meet the Team! Deputy District Attorney III Responsibilities Prepares and files appellate briefs; responds to writ petitions and habeas corpus matters; handles post-conviction work. Conducts comprehensive record review; prepares legal analyses and documents related to policy and legislation. Evaluates and advises on Brady disclosure obligations; and performs other litigation and appellate duties as assigned. Investigates, researches, and prepares all types of cases for prosecution; presents and prosecutes cases before all courts within the State. Interviews and advises law enforcement officers and the public in regard to the issuance of criminal complaints; acts as a senior deputy for cases in branch Municipal Courts; negotiates with the defense regarding the disposition or modification of charges in cases. Performs legal research in specialized areas of prosecution; studies, interprets, and applies statutes, ordinances, court decisions, and legal opinions. May assist in the training of other deputies. May act for higher level deputies in their absence; dictates correspondence and prepares reports. May coordinate the work of support personnel. Deputy District Attorney IV Responsibilities Prepares and files appellate briefs; responds to writ petitions and habeas corpus matters; handles post-conviction work. Conducts comprehensive record review; prepares legal analyses and documents related to policy and legislation. Evaluates and advises on Brady disclosure obligations; and performs other litigation and appellate duties as assigned. Prepares and presents evidence and arguments for the prosecution of difficult felony cases involving multiple defendants and multiple charges, and having serious consequences of error, or a high degree of public interest. Negotiates with defense counsel regarding the disposition of cases or modification of charges; performs specialized legal research and litigation in unique and complex areas of law; trains and consults with other attorneys on points of law, evidence, and legal procedures. May assign, review, and evaluate the work of journey level deputies in the litigation of civil, misdemeanor, and felony cases of average difficulty and complexity. Directs the planning, implementation, and evaluation of specialized projects. May act for superiors in their absence or at their direction. Deputy District Attorney III Requirements Option I : One year of experience as a Deputy District Attorney II in Riverside County or in an equivalent class with another government agency. Option II : Two years of experience in the practice of criminal law. Option III : Three years of experience in the practice of law. Deputy District Attorney IV Requirements One year of experience as a Deputy District Attorney III in Riverside County, or in an equivalent class in the office of another prosecuting attorney in California. Other Requirements for Both Levels License/Certificate: Active membership in the State Bar of California. Driver's License: Possession of a valid California Driver's License is required. Background Check: Must be able to pass an extensive background check. Knowledge of: Legal principles and their application; California statutory and case law; the rules of evidence and the conduct of court proceedings; the duties, powers, limitations, and authority of the District Attorney's Office; the methods, procedures, and practices of prosecution; professional ethics in the practice of law. Ability to: Analyze complex legal problems and apply legal principles and practices; present facts, arguments, and laws clearly and logically in written and oral form; perform legal research; work cooperatively with others.
