DescriptionThis position can be based in Salt Lake City, UT or Durham, NC and offers a hybrid schedule (50% onsite, 50% remote) with an every-other-Friday-off schedule (9/8/80).The Legal Counsel, Commercial Operations, Direct Sales - NORAM & LATAM will provide advice and counsel on a wide variety of issues including commercial, regulatory, compliance, employment, litigation, and intellectual property.Local Position DutiesAddress a wide range of Industrial and Clinical Applications Unit transactional matters, including drafting and negotiation of contractual relationships, with a significant focus on supporting sales, marketing & communication, customer service, and operations, with customers, suppliers, service providers, collaborators, and consultantsReview marketing, promotional, and scientific activities and materials for compliance with company policies and applicable laws and regulationsProvide guidance and training to assure compliance with applicable laws and regulations, including analysis of relationships with healthcare professionals both in the US and abroad, including but not limited to the US anti-kickback law, the FCPA and other anti-corruption laws, and helping to ensure that bioMérieux’s compliance program is robust and effective at managing and minimizing riskPartner closely with other bioMérieux internal stakeholders and LCI&PA colleagues on various initiativesProvide analysis, risk assessment and counsel on various other relevant legal issues as they arise, including but not limited to regulatory approval process, intellectual property, employment, data privacy, litigation & pre litigation and competition lawKeep track of developments in medical device regulation and enforcement and other areas of responsibility, and apply that knowledge to anticipate and address emerging risks to the companyActively manage external legal counsel to ensure appropriate service and quality levels and contain costsDesign and deliver training programs for business colleagues on a variety of subjectsManage and monitor the Company’s contract termsAbility to work with all functional areas and levels of the organization to address a wide variety of issuesEmploy and exercise judgment to analyze issues and make recommendations with minimal or no supervisionPerform all work in compliance with company quality procedures and standards.Perform other duties as assigned.QualificationsRequired Education, Training and ExperienceJ.D. and bar admission required2+ years of experience in commercial transactions, litigation, healthcare, or other related legal fields, gained through a law firm or in-house legal role.Preferred Education, Training and ExperiencePrior experience in medical device, life sciences, or clinical diagnostics is a significant plusWillingness to undertake some travel, including international travel, in support of responsibilitiesKnowledge, Skills, and AbilitiesConsistently upholds and reflects the core ethical principles and values that bioMérieux promotes.Demonstrates assertiveness and confidence in the face of a challengeEffective verbal communication skillsBusiness acumen to understand how a business operates and how to make it successful.Action Oriented: Takes action even when facing challengesBuild and maintain positive, productive interactions with colleaguesSkilled in MS Office tools to include but not limited to Outlook, Teams, Word, and ExcelThe estimated salary range for this role based in Utah and North Carolina is between $114,000 – 150,900. This role is eligible to receive a variable annual bonus based on company, team, and individual performance per bioMerieux’s bonus program. This range may differ from ranges offered for similar positions elsewhere in the country given differences in cost of living. Actual compensation within this range is determined based on the successful candidate’s experience and will be presented in writing at the time of the offer.
