Job Overview
The Commissioner of Securities and Insurance, Montana State Auditor's Office, is currently seeking a candidate to fill the role of a Compliance Specialist in the Insurance Consumer Services Bureau (ICS) within the Insurance Division. ICS is committed to serving the insurance needs of Montanans with a focus on providing excellence in customer service. ICS is responsible for ensuring compliance with the provisions of Title 33, MCA and Administrative Rules of Montana (ARM) by insurance entities for insurance transactions in the state of Montana. This includes sales, underwriting and issuing of policies, claims, rescissions of policies, premium refunds and other issues surrounding insurance. This is accomplished through the investigation of consumer complaints and inquiries to determine whether the insurance entity is compliant with state and federal laws related to insurance and are compliant with the provisions of the contract of insurance issued to the policyholder.
ICS has a significant role in the overall regulation of the insurance market by investigating and tracking insurance-related violations of MCA Title 33. Its efforts may prevent small violations from becoming business practices of the insurance entity which harm a class of policyholders and are difficult and expensive to correct.
ICS also educates insurance consumers about their rights through public outreach and publications written and printed by the department. ICS ensures these documents accurately reflect Montana Insurance Statutes. The efforts of ICS staff are essential in establishing a regulatory system that ensures policyholders are protected from violations of insurance statutes or violations of the company's contract provisions while enforcing a system of regulation that fosters a healthy marketplace environment for the entire insurance industry.

What can you offer us?
The successful candidate will work within our Insurance Consumer Services (ICS) Bureau and be responsible for ensuring compliance with the provisions of Title 33, MCA and Administrative Rules of Montana (ARM) by insurance entities for insurance transactions in the state of Montana.
This position is an entry-level position. Training for the position may last up to one year, which is dependent on the qualifications at the time of hire. During this time, the successful candidate will be responsible for the following:
- Investigating and analyzing property, casualty, life, and health insurance complaints.
- Determining merit of further investigation based on type of complaint, severity of allegation, impact on the individual and complaint history of agent or company.
- Evaluating policies, rules, laws and other factors to determine if a violation of law did occur.
- Compiling and documenting evidence of irregularities, improprieties and violations of civil and administrative codes.
- Determining if there is sufficient evidence to recommend action for administrative or criminal procedures.
- Testifying on insurance practices, procedures and policies in administrative hearings.
- Engaging in dispute resolution to settle consumer complaint/ mediate on behalf of consumer.
- Providing insurance information to consumers using knowledge of state and federal insurance laws, rules, regulations, procedures, case law and common business practice.
Minimum Educational and Experience Requirements:
- Bachelor's Degree in Business or related field.
- Minimum of three (3) years of related insurance experience.
- Three or more years of Property & Casualty or Life & Health experience is preferred.
- A combination of education and experience will be considered on a case-by-case basis.
Competencies:
The successful candidate should possess the knowledge, skills, and abilities in the following areas:
- The successful candidate will have strong written and oral communication skills and must be able to handle a variety of sensitive communications with individuals, both externally and within the agency.
- This role requires the ability to conduct effective investigations and interview individuals to obtain information.
- Ability and willingness to provide excellent customer service.
- Must demonstrate knowledge of insurance industry-specific rules, regulations, and statues to determine the nature of violations or discrepancies, and the type of action to be taken.
- The successful candidate will have knowledge of all lines of property &casualty and/or life & health insurance regulations for the state.
- Must demonstrate skill in handling complex legal disputes, be able to interpret governmental regulations, make informed decisions that are supported by legal analysis and facts, and negotiate settlements.
- The role often handles a heavy caseload, therefore the candidate in this position must be able to effectively manage their time and work with minimal supervision, sometimes under tight deadlines and pressurized working conditions.
- Must demonstrate a continued willingness to learn and cross-train on either Life and Health or Property and Casualty complaints.
